Regular City Council Meeting November 1, 2022

El Cerrito City Council Chamber, hybrid · 1 hour 16 minutes · 461 caption units

Council: Gabe Quinto, Mayor · Lisa Motoyama, Mayor Pro Tem · Janet Abelson (remote) · Paul Fadelli · Tessa Rudnick

Staff: Karen Pinkos, City Manager · Melanie Mintz, Community Development Director · Sky Woodruff, City Attorney · David Yun, Fire Prevention Officer · Chase Bachman, Fire Marshal

Presenting: Vincent Salimi, Mayor of Pinole

A Human Rights in Iran proclamation brings the Mayor of Pinole and nine speakers. The building code is adopted with a local change: Type A roofing citywide, not only in the highest fire severity zone. One property reaches the fire abatement list. And a resident asks the city to chase federal EV charging money it qualifies for by being near a freeway.

These summaries are written with AI. An AI model (Claude, by Anthropic) drafted the summaries, titles and notes from each meeting’s closed captions, and they were checked against those captions. They can still be wrong, leave out something that matters, or weigh things differently than you would.

  • Captions are automatic and unedited. Names and words are often misspelled or misheard, and quotations carry those errors.
  • Who is speaking is often unclear. The captions rarely say, so a speaker’s name can be missing or wrong.
  • Not the official record. This is an independent site, not the City’s. For what was decided, rely on the adopted minutes.

Check anything that matters against the captions beside each summary, or the City’s recording. How these pages are made

Also, uh, with my colleague, Council Member for Delhi, I attended the Uh accounts Infrastructure District Subcommittee Um, and looking at some all potential funding sources,

0:07:31November Eighth.

0:07:34Thank you very much.

0:07:36Council Member.

0:07:38Thank you. Mayor. Um. I also attended the League of California cities. East Bay Division meeting last Thursday. Um! One of the things we were able to do was honor the outgoing, retiring Council members in the East Bay, one of them being our own Uh Council member, Abelson for her six terms of service. Um it! We was a really wonderful celebration. We were the host city. Here, in El Cerrito. In addition to the presentation we received from the League of Women voters, we also received a presentation

0:08:07from the county and the a three program which is a a mental health um Emergency support service, that of city collaborated with all of our cities in the county. On one, an award from the League of California Cities.

0:08:23That was the Helen Putnam award for a collaboration. It was a really wonderful event. We were happy to be the host city um, and other than that I didn't attend a lot of events. But I do want to put in a plug while I have the microphone that if you have young children, please get the new Covid booster for them. Uh, it has been approved. It was last month it was approved. So now that we're going into cold and flu season. Make sure that your younger ones both have their flu shots, and that they have the new

0:08:53um they need. Booster.

0:08:56Councilmember Abelson: Thank you very much. Okay, Uh, thank you. We'll next go uh uh to the screen over there with Council Member Abelson. Uh: do you have any updates for us. Council Member. Um, I was just gonna I It's almost a repeat of what was just said. But I can say that I did go in

0:09:14and get my flu shot

The City Manager reported that on 21 October Contra Costa Health Services had repealed all county health orders — “there are no more in place.”

The state emergency would end at the end of February, which would affect AB 361 and therefore how the Council and its advisory bodies meet.

Staff would return with legislation on the temporary outdoor dining program and further discussion of the eviction moratorium.

Motoyama, Abelson and another councilmember all reported attending the League of California Cities East Bay Division meeting, hosted in El Cerrito.

Motoyama also noted a League of Women Voters presentation on mis- and disinformation, and that she and Fadelli had attended an infrastructure district subcommittee looking at funding sources.

What it recognized: the county's A3 program — “a mental health emergency support service” the city collaborated on with every city in the county — received the Helen Putnam award for collaboration.

The councilmember who reported the award also urged parents to get the new COVID booster for young children. Abelson, attending remotely, urged people to get flu and COVID shots: “it's not all that hard, and there are any number of locations.”

Fadelli's observation: “Janet has had as many Covid shots as she's been Mayor of El Cerrito.”

Note

The A3 behavioral health program wins a statewide award for collaboration a fortnight before the police chief describes its dispatch protocols as still being worked out. It is the Measure X-funded service residents ask about for the next three years.

02 “Dangerous times in America” captions 33–68

0:09:17Councilmember Abelson: and my um

0:09:20this Covid shot

0:09:22and um I would encourage others to do the same.

0:09:27It's not all that hard,

0:09:29and there are any number of locations where you can do that. I believe you can do it through the county. I happen to do it through Kaiser

0:09:38Um that, Anyway, you can um choose the location where you would like to go. But I do encourage people to go and get that chat, because that's how we don't get other things like Covid and the flu

0:09:53um. So and I also, as was mentioned, attended the League of California Cities

0:10:01uh East Bay Division meeting in El Cerrito, and it was a great meeting, and um! I was honored to be recognized for my um terms of service. Thank you.

0:10:14Thank you. Let's go to Council Member for Delhi. Yeah, thank you. And good evening. And

0:10:19I just wanted to point out that Janet has had as many Covid shots as she's been Mayor of Elsa Rita. That's quite an achievement. It's really a wonderful thing. I was lucky enough to actually uh take the place of our Mayor Mary Kinto at the Chambers, Pastavel Cerrito awards

0:10:37uh last month. Uh, that was a wonderful event at the Joku uh venue here, and Elsa Rito really celebrating our small businesses during their uh, the tough time during

0:10:49Covid, and to get the community involved with voting for the favorite things in El Cerito in the region, and there are many things so thank the Chamber of Commerce for that,

0:11:00and also coming up um this Friday, the fourth of November, the for the fifth year, in a row on Sant Pavil Avenue, the chamber will be helping to celebrate the lighting of our trees along the theatre district and elsewhere. So there will be food and beer available for anyone coming

0:11:16at reasonable, if not free prices. So do show up for that some other positive news. Speaking of trees or trees that have for a long time blocked between the West County unified school district

0:11:30and our community center, and we've gotten some positive words from our city staff this week that there's a movement to begin to trim those trees so that we get more solar

0:11:39energy on our solar parking lot there at the Community Center, and I wanna especially thank Trustee Leslie Reckler for her assistance, and moving that long and working in a cooperative manner with our school district,

0:11:52and finally, as our Mayor pro Temp said, obviously we need to vote on uh

0:11:58this November eighth. The county clerk here in Contra Costa has reported that elsewhere the only has cast thirteen of their boat so far, and there are six other county cities that have greater turnout than we do, So please get out and vote.

0:12:14These are dangerous times in America,

0:12:18so I hope we will vote and support local and national candidates that support the truth

0:12:27that support election results and that support our democracy.

0:12:31Thank you very much.

0:12:33Thank you. Um. I also want to.

0:12:40I also want to report that i'm. I also attended the uh, the California City Division uh dinner, and and uh great, to see a lot of the uh

0:12:51outgoing uh leaders that we have here in the in Spain we need to enter cost accounting that will be retiring, including, uh, our dear colleague here, Council Member Abelson and uh,

0:13:04I got to say uh so long, and goodbye Well wishes to the day, or he was uh retiring, and we will have uh more uh folks that will be retiring after uh

0:13:17uh, in the December meeting uh under Custom Mayor's conference.

0:13:22Rich man

0:13:24in uh December. So I look forward to uh attending that I want to say uh a shout out, Uh, yeah,

0:13:31Thank you. To the south side of the city, where uh Cecilia and her

0:13:39uh young children. Uh, yeah, They're located on the south side of.

0:13:44They invited the fire department and the Mayor to

0:13:47and their Halloween party at the

0:13:51also Park station,

0:13:53sort of the parking lot, there great to meet

0:13:56a lot of our new residents who are uh happy that they had a chance to move here. Many of them are uh newcomers here to also read out, and to see a brand new generation going up here.

Fadelli reported that trees blocking the solar parking lot at the community center were finally to be trimmed, thanking a school district trustee for moving “that long”-standing problem.

He noted the chamber's small business celebration and a San Pablo Avenue event in its fifth year.

Then the turnout figure, a week before the election. The county clerk had reported that El Cerrito had cast “thirteen of their [vote] so far,” and that “six other county cities … have greater turnout than we do.”

His framing: “these are dangerous times in America.”

And what he asked people to vote for: “local and national candidates that support the truth, that support election results, and that support our democracy.”

Quinto reported attending a Halloween party hosted by a resident on the south side, who had invited the fire department — and meeting “a lot of our new residents… many of them are newcomers,” having moved from Oakland and San Francisco.

Significant

El Cerrito's turnout a week before the 2022 election — “thirteen of their [vote] so far,” behind “six other county cities” — is reported from the dais alongside “these are dangerous times in America.” The same election seats Carolyn Wysinger on the top vote and returns Councilmember Quinto, and the turnout arithmetic the City Manager gives three months later is about 15%.

03 A mile from an interstate captions 69–91

0:14:12Folks have moved from Oakland and San Francisco to our city, and

0:14:17so happy that you there,

0:14:19and thank you to uh Cecilia,

0:14:22or hosting the fire department, and that is Fire Station seventy one and a shout out to Alien and his crew.

0:14:31Friday night I did attend the rotary cocktail party with our city manager and uh, our rotary president, who at the should be our police

0:14:41and great to attend that, and thanks for the invitation.

0:14:46We could show that with uh Uh Rotarians from all over less Contra Costa, we did have some Rotarians from Albany as well. So it was a good crowd, and uh great to uh

0:14:59a lot of the.

0:15:03So uh, next we're going to go to all locations from the public. Uh, now is the time for members of the public to wish to provide public comments regarding matters not on the agenda, consent items and presentation items,

0:15:18and the person speakers can submit a speaker card to the city clerk, and remote speakers should use a raise hand feature to the to speak. Please remember to identify yourself and your city of residents at the beginning of your comments, and we we have a special group of uh residents here, and you will be able to speak uh when we pull the item. So uh, just one to let me know with advance. And that city clerk Go ahead.

0:15:45Thank you, Mayor, and for those of you who are on the call, the mayor is referring to consent. Item B for human rights and Iran proclamation. So if you wish to speak on that item, please do not raise your hand at this time. You have an opportunity soon to uh comment on that.

0:16:00So at this time we will do all other requests to speak, which we will start with in person, and our one speaker. Not on this item at this time is Vanessa War. Height.

0:16:18Good evening, Hi, everyone. My name is Vanessa Warh. I I live in El Cerrito. Um!

0:16:24Uh! I have two things I want to speak to one is um fire safety. I was recently given a tour of the hillside natural area, and um was

0:16:37I. I had always thought that I, living down in the flats with the metal roof. Um was in a pretty safe fire space, and after seeing the

0:16:46groves of eucalyptus, I am now really scared. So um i'm delighted that our fire department is taking this seriously and working in collaboration with fire departments up and down the East Bay hills.

0:16:59Um, However, I feel like our city needs to do more, and we should really be looking at pulling out those eucalyptus groves, replacing them with fire, safe oak trees

0:17:09um, and working more collaboratively with, uh make Elsredo fire safe. This community neighborhood organization. Um, it would be great. I actually passed a fire wise. Usa. Signed today in a neighborhood, and it made me happy, and we just need a whole lot more of those in a lot of places so like to encourage the city to do more on that front.

0:17:29Um! And then the other thing is, I sent an email to the city manager and to a some of the folks on the Council about this. Um. There is a lot of Federal money now available for uh, many things for greenhouse gas reduction, but in particular, right away, there is money for electric vehicle charging infrastructure.

0:17:49Um! I have talked with the head of public works here a little bit about this and sent her a note as well. But I just want to make everybody aware of the fact that there is Um, the national electric vehicle infrastructure funding

0:18:01five billion dollars being directed, and it's being directed at communities that are within a mile of an inner state which our city is

0:18:09happily in this case located that close. So we qualify. So I would like to encourage the city to do more, to pursue that funding to bring that money here into our community and see what we can do with it. And lastly, I want to thank you for um supporting the rights of women in Iran. I think that's really important that we take a stand. Thank you,

0:18:30thank you. And then I will do one last call. If there is any speakers on Zoom tonight who wish to speak on items, not on the agenda or consent items, not including the Iran Proclamation. Now would be the time to raise your hand.

Vanessa Warr raised two things.

The first was fire. She had been given a tour of the hillside natural area, having assumed that “living down in the flats with the metal roof” made her safe.

After seeing “the groves of eucalyptus, I am now really scared.”

Her ask: that the city go further — “really be looking at pulling out those eucalyptus groves, replacing them with fire safe” oak trees — and work more closely with Make El Cerrito Fire Safe.

The second concerned money the city may be leaving on the table.

Her report: there is federal money for electric vehicle charging infrastructure — the National Electric Vehicle Infrastructure funding, five billion dollars — “directed at communities that are within a mile of an interstate, which our city is happily in this case located that close. So we qualify.”

She had written to the City Manager, councilmembers and the public works director, and asked the city “to do more to pursue that funding.”

Significant

A resident identifies federal EV charging funding she says El Cerrito qualifies for because it sits within a mile of the freeway. She raises it with staff in writing as well as from the podium; the program is not mentioned again in the archive's captions.

I put a dress for not being with here tonight. I'm actually at this penal city council we do have a meeting as well. But first of all, I would like to congratulate you

0:21:45for this proclamation. That really means a lot to me. I was born in nineteen eighty, and Iran and I left my family left with the half of my parents. We moved to France at the age of four years old, and then I moved to the United States by myself with five hundred dollars

0:22:20gender age and religion. Unfortunately, a lot of people in the world do not enjoy this

0:22:27liberty, including the woman in Iran.

0:22:30We all come from a beautiful mother. We all love our mothers, and the way the woman that being treated today in Iran is just unacceptable.

0:22:39I would like to congratulate you for that proximation. I would like to congratulate you again for the respect you are putting into woman's life and live in general, and I wish the best to the city of Al Cerrito, and also wants you,

0:22:52and I hope that all the cities will follow as well. Thank you very much on on behalf of the city of Pino and the Resident of Penal.

0:23:12Mr. Mayor, thank you for joining us, and we have a a fantastic group of people here. Uh, that will also like uh, most likely, will want to speak on this. Uh. So again thank you for your leadership, Mr. Mayor.

0:23:30Thank you, Mayor. So at this time we have nine requests to speak, and if you are calling in Via Zoom, and you would like to speak on this item, now would be the time to raise your hand After we conclude the In-person speakers, we will go to any additional speakers via zoom

The consent calendar was adopted with two items pulled, and the Human Rights in Iran proclamation heard separately.

Many residents had come for the proclamation. Quinto noted the presence of Vincent Salimi, Mayor of Pinole, joining remotely.

Salimi gave his own history: born in 1980 in Iran, his family left — he arrived with “an English dictionary, and I couldn't speak in English, but I was looking for the American dream.”

He came to the United States nineteen years ago; four years ago he was elected to the Pinole City Council, and is now its mayor.

His framing of what liberty means, and who lacks it: “a lot of people in the world do not enjoy this liberty, including the woman in Iran.”

And his appeal: “we all come from a beautiful mother. We all love our mothers, and the way the woman that [are] being treated today in Iran is just” — unacceptable.

His hope: “I hope that all the cities will follow as well.”

A neighboring city's mayor, who left Iran at four and later came to the United States alone with “five hundred dollars” and an “English dictionary,” joins an El Cerrito meeting to thank it for a proclamation. Nine requests to speak follow him.

0:26:20for this proclamation and hope

0:26:23that all cities in the Us. And other countries will follow suit.

0:26:27Thank you very much. Thank you.

0:26:44Uh, dear uh Mayor Quinta and um

The first speaker, a resident since 1996, began with an instruction to imagine.

“Imagine being arrested or killed simply for showing your hair, or holding your boyfriend's hand in the public.”

The case he named: a 22-year-old killed “just because her head covering was not good enough for the morality police.”

His comparison with where he now lives: “you are lucky to live in an inclusive and progressive community” — he and his wife had raised two daughters here, “in a community which values human rights and freedom.”

Against that: “girls as young as twelve are killed in Iran for simply showing their hair.”

He also drew the connection to Ukraine: the regime “is using kamikaze drones in Ukraine, killing Ukrainians, and using brutal force to kill their own people.”

His assessment of what a proclamation does: “this proclamation, although symbolic, sends a message of unity to those around the world.”

He closed with lines said to be inscribed at the United Nations: “human beings are members of the whole, in creation of one essence and soul… if you have no sympathy for human pain, the name of human you cannot” retain.

He added that freedom should be achieved “without the intervention of other countries who may support groups which are not accepted in Iran.”

Significant

“This proclamation, although symbolic, sends a message of unity” — a speaker naming the limits of what he is asking for while asking for it. The same argument is made from the other side during the ceasefire resolution debate two years later.

0:26:58Um. Elsa Retail has a history of being very progressive, and the history goes longer than Berkeley for those who don't know.

0:27:10Thank you for recognizing um

0:27:13this symbolic gesture of human rights.

0:27:18I realized that we're far away from a country that atrocities to women and others are are happening.

0:27:29But, uh,

0:27:30you and us are sending inspirational message. Um! That it's consistent with um

0:27:39um with how uh, we want to be living, and uh, we had the privilege of living here in Elsa Rita or elsewhere. Um,

0:27:49and and we expect that um

0:27:53um our message will

0:27:57go further, then. Uh, we are here and be able to create positive movements.

0:28:04Uh in the country of Iran.

0:28:07Uh being uh from a um

0:28:11Iranian American community.

0:28:13Um!

0:28:21There is a lot of pain,

0:28:33and and we hold that hands.

0:28:40I like to um

0:28:43to end by recognizing the courage that

0:28:51the women of the Yvonne

0:28:53in Iran and outside have um

0:28:58women live celebrity. Thank you.

0:29:08Our next speakers is Fondi are Imani, followed by Julio Niazi.

0:29:23Good evening,

0:29:24City council.

0:29:27My name is Espandier Emani I'm. A long time Barrier, resident living in Berkeley.

0:29:33I'm. Here to thank you and the city of Elsorito

0:29:36for your support of the Iranian people in these critical times,

0:29:41but they truly need and deserve support from all corners of the world

0:29:48as we speak, the world is witnessing a brave uprising,

0:29:52initiated and led by women

0:29:55fighting against tyranny and operation,

0:29:58fighting for freedom and democracy.

0:30:02The least we can do here today, ten thousand miles away

0:30:08is to show our solidarity with them,

0:30:16and at the same time

0:30:18letting the from the Government know

0:30:21that we are watching them as well,

0:30:23and holding them account.

0:30:26I urge everyone here, and not only the Iranian American to contact our State and Federal Government representatives

0:30:36to voice our support for the Iranian people and ask them to move away from appeasement and enabling policies.

0:30:45The Islamic Republic,

0:30:47including any nuclear deal or sanction

0:30:51for more than four decades.

0:30:54The Iranian people with immense resources and reach culture have been deprived brutally

0:31:01from their human rights

0:31:03and basic needs

0:31:06as it's evidence. Now

0:31:08they are fed up with that exploitation,

0:31:11fed up with Islamic government, lies

0:31:14fed up with

0:31:16astronomical corruption. Fed up with this divisiveness,

0:31:21fed up with their disastrous domestic and foreign policies,

0:31:25and fed up with the lack of respect

0:31:27and values for their own citizen

0:31:31in particular. For women

0:31:33you are fed up and want a free, secular government for Iranian people

0:31:38by the Iranian.

0:31:40One last comment:

0:31:42The current uprising in Iran is pure grassroots, with no political organization behind it.

0:31:50You don't see any flags

0:31:52in the streets,

0:31:54and we don't hear any chance in support of any political organizations.

0:31:59I wish all the political organization here and around the world would respect that, and do not create diversions

0:32:07and divisiveness

0:32:09in this moment.

0:32:10X. And the you,

0:32:13woman live freedom. Thank you for your time.

0:32:22Our next speaker is Julio Niazi, followed by Bauman Amadi.

A second speaker noted the city's history: “El Cerrito has a history of being very progressive, and the history goes longer than Berkeley, for those who don't know.”

The speaker's acknowledgement of distance: “I realize that we're far away from a country [where] atrocities to women and others are happening” — but “you and us are sending [an] inspirational message.”

A Berkeley resident thanked the city and made a specific ask of everyone present: contact state and federal representatives “to voice our support for the Iranian people” and ask them to move away from “appeasement and enabling policies” toward the Islamic Republic, including any nuclear deal.

His characterization of what is happening: “a brave uprising, initiated and led by women, fighting against tyranny… fighting for freedom and democracy.”

His last comment:

“The current uprising in Iran is pure grassroots, with no political organization behind it. You don't see any flags in the streets, and we don't hear any chants in support of any political organizations.”

His request that followed: “I wish all the political organizations here and around the world would respect that, and do not create diversions and divisiveness in this moment.”

Significant

“You don't see any flags in the streets” — a speaker asking organizations abroad not to attach themselves to a movement that has deliberately avoided banners. He is asking a city council to lend support without lending a label.

07 Four people's time captions 226–263

0:32:31Thank you. Mayor and City Council members. Um! Four people have asked them ask me to take their time because they want me to do this whole thing if I If you want me to say the names, I am okay, Absolutely. That's great. Thank you so much.

0:32:46So dear May, or uh Kinto and Dial through the City Council. Thank you for this opportunity to declare my solidarity with the evolving revolution in Iran for basic human rights led by women and the use demanding of free, democratic and just society.

0:33:02My name is Charlie Niazi. I'm. A pediatrician in Berkeley, serving the Bay area communities as women all across the country, and Iran, supported by most members of society, are putting their bodies and their lives in front of a brutal militarized police, demanding basic human rights, chanting Zen's and viaz Id

0:33:20woman Life, liberty. We must amplify their voices. The unarmed demonstrators, some as young as eight, are facing batons, guns when arrested torture and death in the dungeons of the Islamic Republic of Iran.

0:33:35Yet they keep on showing up on the streets, demanding freedom and the end to the suppressive regime.

0:33:41These women are standing on the shoulders of women who have paved the way. No one has been a stronger defender of rights of women, children, and ethnic and religious minorities, that Miss Nasty Nissou today, who is currently serving a sentence of thirty-eight years and one hundred and forty-eight lashes

0:33:57all lead on medical furlough for simply being their lawyer and speaking the truth.

0:34:03Norman's Iranian Mandela, due to her stance against General a far side. She was recently interviewed by Time Magazine on September twenty ninth, two thousand and twenty-two at great peril to herself.

0:34:14I quote this is one of the most extensive protests that you've we've had in spread to cities and towns all over, as you know, this spark, for it was the killing of mass Amini which really embodies by itself the forty-three years of pain that women have endured in this country.

0:34:31This is for us a physical bodily experience. It says real an aspect of life here as it could be. Sentence after sentence, ruling after ruling are imposed on our bodies in terms of our dress, and not only that, but rape and other transgressions.

0:34:49They hit you and hurt you and bruise you and wrap you up in the veil once again that conceals the harm that's inflected on you,

0:34:57she goes on to say that these demonstrations could lead to a regime change in States. We expect support from everyone because we are defending our common values and principles, so how can we, outside of Iran, support them? The United States, the most powerful country in the world, was founded on ideals of justice and liberty,

0:35:17albeit for a select section of society, but having the capacity to change to realize it for all members. Unfortunately, it's foreign policy has been toxic to the Middle East. However, her people are some of the most decent people I have ever met.

0:35:33President Biden, in his first State of the Union speech, spoke of upholding human rights around the world. This is the time to show that he means what he said. I know that this is this is tricky giving the history of the Cia credits in one thousand nine hundred and fifty-three, overthrowing your popular Prime Minister Dr. Mosade.

0:35:52And the fear of labeling this movement as American but standing up for Women's rights should not be that difficult. President Obama just recently stated that he had wish he had done more to support the two thousand and nine green movement.

0:36:05First of all, we must not enable the Islamic Republic by providing it funds in any shape or form. So the United States, or any other democratic country should not legitimize the brutal regime by negotiating with them no nuclear deal.

0:36:19As a matter of fact, the American Government should seize the assets of all of the Iranian Government officials, and arrest at the minimum to port them out of the country, because they have been found guilty of crimes against humanity in international courts. Most recently in August, of two thousand and twenty-two in sweden

0:36:37the us should use its influence to ask its allies to do the same,

0:36:41while the Iranian Government and the security forces have made life for their own citizen unbearable. How dare they send their children with the money they have stolen from Iran to Western countries to live freely in in luxury

0:36:53mit ctl, and sees their assets and deport them. Our first Lady, our Vice President, our first ladies, women, leaders in Congress, and broadcasting and entertainment and other influencers, should voice repeatedly their solidarity with the women and the people of Iran. Two

0:37:07military intervention is not an option but support of the Internet and communication systems is a Must I thank President Biden for working on this

0:37:16President Biden, please don't sit with wolves and uh sheep skin, who are pretending to represent the Iranian community abroad, but have other agendas. Nayak for years has white wash to human rights violations in Iran. They do not represent the Iranian American community, nor the Iranian people, but the interest of the regime. This is the group that influence President Obama's decision. Another group, the Mojadina Foul, fought on the side of Iraq and the Iran Iraq War, and have little following in the country.

0:37:44So, even though Mr. Asimi, who is now being interviewed by many news outlets, claims that Miami Rajiv, their leader, is leaving this movement and is simply a lie The women, the youth of Iran, are leading this movement.

0:37:57Listen to their voices, help them, realize their dreams, and after they have overthrown this regime, use your power to have an International Committee monitor a fair election in Iran, Despite the Islamic Republic of Iran's rhetoric Iranians love Americans and American values. Actually It is a two way street.

0:38:16The founding fathers consulted a consulted cyclopedia, found thousands of years ago to see how to govern and honor a land made of different ethnicities, religions, and languages.

0:38:27President Biden, if you do what America at its best stands for, it will not only free a people from an oppressive regime, but will have the added benefit of when we do many more votes in November.

0:38:40But what can ordinary citizen do to support democracy in Iran share? And we share on all platforms any news that comes about Iran to keep this struggle alive in the world's eyes, because the Islamic Republic is counting on people losing interest,

0:38:56call out those who are providing fake news about these demonstrations sign petitions In support of the movement. For example, there is a petition circulating, requesting the United Nations to remove the Islamic Republic from Un's Women's Rights Commission. What a force, you know, University students are under attack by the militarized police.

0:39:16We here can write to our universities and ask them to write a statement of solidarity with them. Health care workers, including a physician and medical student, have been killed by the police. International medical organization should make statements of solidarity with their colleagues in Iran,

0:39:30because the wounded can and do get arrested and going to hospitals. The Ama can set up telehealth, capabilities to try to attend to their wounds outside of a health care, facility, and ten rallies in support of the Iranian movement which is every Saturday, and contact your representatives to pass resolutions in support of human rights and against human right violations that are happening in Iran.

0:39:50This is the United States of America, and people have the right to hold their representatives accountable. This is what a free society looks like. I am here today. Because of this fact,

0:40:01Mayor Kinto and El Cerrito City Council. I thank you for your strong support of human rights, particularly Women's rights in Iran. With this proclamation El Cerrito joins uh the other eighteen contrast to cities uh Contract Conference costs to county cities. In issuing or in training to issue a resolution

0:40:21due to the strong leadership. Mayor Sally Me. From Canol, The Alameda County Democratic Party and University of California Student associate are two Uh. Co. Signatories of a similar resolution

0:40:32Mit, Ctl. And cities of Berkeley, which was the first city on Clinton Andoryville and Santa Cruz, have already passed resolutions in support of human rights in Iran. We hope to build this movement all across the country, signing up as many cities in the Us. And outside of the United States, one hundred and fifty,

0:40:46modeled by the successful campaign for Nelson Mandela, and against the South African apartheid system initiated by Glasgow, Scotland, eventually signing up more than two thousand five hundred cities in fifty-six countries around the world,

0:41:00the Iranian Mandela, and the Women's Rights Movement deserve nothing less

0:41:04here. Mayor Kinto and the Al Cerrito City council. Thank you for being the voice of the Iranian women and the Iranian people. In giving me this opportunity to express my opinions. Xanz and the Yazidi. Thank you so much.

0:41:25My next speaker. Excuse me. Our next speaker is Bauman Amadi, followed by Mona Afari.

One speaker, a Berkeley pediatrician, had been given the time of four others so she could deliver a longer statement.

Her account of the demonstrators: “unarmed demonstrators, some as young as eight, are facing batons, guns — when arrested, torture” — “yet they keep on showing up on the streets.”

She quoted a jailed Iranian human rights lawyer, on medical furlough “for simply being their lawyer and speaking the truth,” from a recent interview: “this is for us a physical, bodily experience.”

And the line she chose to read: “they hit you and hurt you and bruise you and wrap you up in the veil once again, that conceals the harm that's inflicted on you.”

Her asks of the federal government were specific: do not provide funds “in any shape or form”; seize the assets of Iranian government officials; and support “the internet and communication systems” — though “military intervention is not an option.”

And her list of what ordinary citizens can do: share news, call out false accounts, sign petitions, and ask universities and professional bodies to issue statements of solidarity.

Her model: the campaign against South African apartheid, “initiated by Glasgow, Scotland.”

She named the cities that had already acted: Berkeley — “the first city” — plus Clinton, Emeryville and Santa Cruz — and said El Cerrito joined eighteen other Contra Costa cities issuing or intending to issue such a resolution.

Significant

Four speakers ceded their time so one could give a single statement of about nine minutes in place of five separate ones; no one objected.

08 Adopted, and a letter captions 264–280

0:41:36Oh,

0:41:38both of those individuals. Uh, okay, uh Anita

0:41:45Shane

0:41:48Fijian.

0:41:53Okay, Mayor, that concludes our request to speak.

0:41:56Very good. Um. I want to say to the audience and and to residents watching this telecast that you know,

0:42:04with Uh Mayo Salini, and uh, the Mayor of Penol. And uh, my colleague, the Mayor program uh set me shine in West Hollywood.

0:42:14Yeah, I'm just very, very

0:42:21so. Um, we wanted to uh um do a motion here and first, and when anyone like to move this second, in case we have a motion by uh, the Mayor protem, and a second by Council. Member Rundate

0:42:41Councilmember Abelson: I.

0:42:42Councilmember, Fidelity, Councilmember Redneck. A motion carries

0:42:47Thank you.

0:43:21X. We will go to. Uh fiveg.

0:43:26Yes, and I I just wanted to roll. Call on that. I don't have any comments. And

0:43:32would anyone else like to

0:43:37um Do I have a lesson.

0:43:42Yes, I'll move that. Okay. Do I have a second.

The proclamation was moved and carried.

Quinto noted for viewers that the effort connected to colleagues elsewhere — the Mayor of Pinole, and a counterpart in West Hollywood.

The Council then took the item it had pulled from consent: a letter of opposition on a California Public Utilities Commission rulemaking.

It was moved and carried on a roll call, with no comments offered from the dais.

A federal update from Congressman DeSaulnier was postponed to a later date.

Cross-reference

The CPUC rulemaking opposed here concerns net energy metering — the compensation paid to rooftop solar owners. Rooftop solar is also the resilience answer a councilmember offers a month later when asked whether the grid is physically defended.

09 One property, one neighbor captions 281–320

0:43:46Okay. We have motion by Deli, and second by the airport down.

0:43:56Councilmember Abelson: Aye, I'm from

0:43:59can't remember what Nick Hi machine carries.

0:44:02Thank you very much.

0:44:07Next me uh Number Six. The Federal update from Congressman to Sony has been uh moved to a latter date. So we will go to a public hearings next and uh seven A is a public hearing on the fire hazard abatement,

0:44:27and we have a David joined a fire prevention. Officer Chase, backman, fire Marshal from the else State of our department.

0:44:36Good evening.

0:44:40David Yun: Hello! Hi! How are you? Everybody? Um! So we have

0:44:45uh fire hazard abatement uh list to be voted on today. We have one property.

0:44:51Um! That's made it into round four over a statement. Process. Um! However, the neighbor of the property just contacted us today, he said. The owner has been out of the country for six months, so he hasn't been receiving his mail. Um, but he said, he is typically pretty good um about maintaining his property, and he doesn't see any issue

0:45:12with them doing that as soon as he knows what the issue is. So um! He has agreed to kind of facilitate that with me. Um, so i'm not sure how you want to proceed. If you do want to go forward with the Declaration,

0:45:25or uh wait till after I talk to the property owner, and we can come upon a work agreement. Um! So i'll. I'll leave that up to you at this point.

0:45:34Um!

0:45:36Let's talk to the city attorney here. Uh, hi! Hi! Good evening. I would suggest, moving ahead with um, holding the hearing and adopting the resolution, so that in the event that um things are not able to be worked out the fire department will have the authority.

0:45:54Um topping the resolution to the fire department.

0:45:59David Yun: Okay,

0:46:03um. Do you want to give us a more of a report. Then.

0:46:07Uh, David.

0:46:09David Yun: Uh, yeah. So the address is one thousand three hundred Devonshire uh drive, and there are some dead trees on the property that need to be taken down. Um, and that's it. The rest of the property is fine.

0:46:23Okay? And that's the only property up for declaration today.

0:46:27Okay, Got that? Um! Let's go to uh the Council any questions, for, uh, uh, David, you

0:46:37I would move this.

0:46:39We need to have a public.

0:46:43We do. We do have one resolution that needs to be adopted prior to opening up. That's what I was moving. Okay, do I have a motion to approve the both solution declaring, identify properties with revised Exhibit A.

0:46:58I moved, I so moved.

0:47:01Got it.

0:47:02I have a motion from Fideli and a second from Uh

0:47:06uh fair for ten. Oh, oh, Council Member, run that. It's fine.

0:47:11All right. That's it. Clerk.

0:47:13Who's the second? I'm: Sorry to clarify. Okay, Thank you. Mayor Kinto. Yes, Council Member Abelson

0:47:21I'm. From over Fideli Council Member and me. I question carries

0:47:27uh next, we are going to open the public hearing and announce

0:47:31the public hearing is now open in person. Request to speak, can submit a speaker card to the city clerk, and remote speakers can use the raised hand feature to request to speak. Please remember to identify yourself and your city of residents at the beginning of your comments, Madam City clerk proceeded.

0:47:49Thank you, Mayor. At this time we do not have any request to speak in person. I do not see any hands online.

0:47:57Very good. Do I have a motion to close the public hearing. Okay, do I have a second

0:48:04uh a second with able since I have a motion from uh mayor for ten and a second from uh councilmember, Abelson. Adam City.

0:48:22Okay, um.

0:48:24Next, we have a uh to approve the resolution overriding objections,

0:48:31a motion to prepare to approve the resolution overriding objections.

0:48:37Do you have a second

The fire hazard abatement hearing concerned a single property.

The fire prevention officer explained where it stood: one property had “made it into round four of the abatement process.”

Then the development of that day: the neighbor of the property had contacted him that day: the owner had been out of the country for six months and not receiving mail, and was usually good about maintaining the property. The neighbor had agreed to help facilitate contact with the owner.

He left the choice to the Council: proceed, “or wait till after I talk to the property owner, and we can come upon a work agreement.”

The City Attorney's advice: proceed with the hearing and adopt the resolution, so that if things could not be worked out the fire department would have the authority.

The property: 1300 Devonshire Drive, with dead trees that needed removing — “the only property up for declaration today.”

No member of the public asked to speak. The resolution overriding objections was adopted.

Significant

One property in the whole city reached the final stage of fire abatement, and a neighbor's intervention on the day of the hearing offered a route to resolving it without enforcement. The Council adopted the resolution anyway, on advice, preserving the option.

0:48:40uh from here for ten uh we have a motion from Is that redneck kind of second from motor i'm not, Madam City Court.

0:48:56Great. Thank you very much. Uh Next, we have the second reading and adoption of building and fire code ordinance, and uh

0:49:06we have uh, who do we have here for this.

0:49:11I'm not sure, because they're identified as community development. But I am bringing them up,

0:49:34Melanie or Keith. If you're on the call, can you raise your hand so I can get you promoted, please,

0:49:41up there. I think Melanie is coming up.

0:50:12Melanie: I am not, either. So we let me. Um. I am checking. But yeah,

0:50:20thank you.

0:50:22Mhm

0:50:33Melanie: great. So I uh

0:50:37holy um

0:50:40often on the second. So we're on the second read, and often on the second read. I think that this is an item sometimes that the quick handles. But we're i'm happy to

0:50:50kick it off if you want.

0:50:53So this the building cut adoption is a slightly different process that i'll just let Sky explain.

0:51:00Alright. Good evening, um. At At your last meeting City Council receipt report regarding uh the the the every three year cycle of updating the uniform building codes uh with local amendments uh the process, because this is adoption of um. Another code. By reference. The process is a little different from normal ordinance adoption only in that where two public hearings are required for both readings. Otherwise it's, it's it's It's your normal process for ordinance adoption.

0:51:30The City Council introduced the ordinance at the last meeting. Um! And so this is just the second reading for adoption. There were there been no changes in between. So this is basically the same item that the Council introduced your last meeting. Normally, this would be on the consent, calendar, and it's just on a public hearing for process sake,

0:51:49Got it? Okay, Thank you very much. Um,

0:51:52uh Melanie. Would you like to add anything?

0:51:56Melanie: Uh, no, thank you for asking, so thank you. Um,

0:52:00um Attorney Woodruff,

0:52:02as I said, as you remember from the first read when we did it last time that we are adopting, as we always do, the local modifications in terms of our own climate, climatic conditions, and uh items such as that, so that they are reaffirmed in every code cycle, since those are. But we haven't made any changes to those. But in response to one of those which is obviously our wildfire uh hazard. We have introduced one thing that would be different than the

0:52:30um. Then the uniform codes, which is to require type, a roofing material throughout the city, instead of just in the very high fire severity zones. So that was the only uh local amendment other than the amendments which are reaffirmed every three years when we adopt the building code.

0:52:47Okay, very good. Thank you. Let's bring it back to the Council. Any questions for Melanie.

0:52:52Okay. Uh, we will. Uh

0:52:59we got open the public hearing.

0:53:04All the hearing is now open in person. Request to speak can submit a speaker card to the city clerk, and remote speakers can use the raisingant feature to request, to speak. Remember to event, identify yourself and your city of residents at the beginning of your comments Now, in city clerk, proceed.

0:53:22Thank you, Mayor. We do not have any in-person requests to speak. And I am not seeing any hands requesting to speak on this item, either.

0:53:35Okay, we have a motion from Redneck and second from Abelson, that and city clerk,

0:53:41Mayor Kinto, Mayor, Pretend Mujayama I. Councilmember Abelson, Council Member Fideli, Councilmember Redneck motion carries

0:53:51Okay, any council uh comments.

0:53:56So I hear a motion to approve.

0:54:00Okay, we have a motion by Motiama and second, by Abelson. Uh let me read this. Uh,

0:54:10let's see um. I have a motion to wait the second reading and the dot ordinance twenty twenty-two three,

0:54:16which adopts a two thousand and twenty-two California green code, administrative building, fire, plumbing, mechanical electrical energy, residential existing building code, two thousand and twenty-one international property maintenance code and related construction codes as applicable to all construction within the city of Elsa Rita, with modifications as outlined in the ordinance,

0:54:40and we have a motion for that we have a second.

0:54:43Um. Yeah, thank you. Mayor Kinto. Mayor I. Councilmember Abelson, Council, Member for Delhi Alright, Councilmember Redneck. I motion carries indexes. Policy. Matters. And We have uh the General Fund Budget Quarterly. Update through September two thousand and twenty-two.

0:55:02Okay,

0:55:03And that was with the city manager, Cambridge. Go ahead. Thank you So much uh your honor. Um, Sandra is off uh

0:55:11this week, and so I am pitching for her. Um! This is the first quarter uh general fund. Update um, as the City Council adopted the annual budget on June twenty first uh for uh fiscal year twenty-two twenty-three um. This is part of our series of uh quarterly updates, as the Council has directed us to submit.

0:55:31Um, The general fund update uh in the first quarter. Um, as you can see, is uh not a lot of activity which is very typical of the first quarter of every fiscal year. Um. The update includes the information on revenues and expenditures. It lists the year to day totals by class, by classification and by department.

The building and fire code ordinance came for second reading, with one new local change.

The City Attorney explained the mechanism: every three years the uniform codes are updated by the state, and the city adopts them with local modifications.

There had been no changes since introduction.

Mintz named the one new local amendment: the ordinance requires Type A roofing material throughout the city — “instead of just in the very high fire severity” zone.

The ordinance adopts the 2022 California green, administrative, building, fire, plumbing, mechanical, electrical, energy and residential codes.

The public hearing drew no speakers, in person or online.

Waived and adopted as Ordinance 2022-03.

Significant

0:55:51Um. This is on a cache basis. So what we're reporting to you is what we've actually received in as of the date of um

0:55:58uh September thirtieth. So some of those um uh some of those fluctuations that you that i'll talk about in a second will be you will be seeing those throughout the fiscal year. Um, some of the highlights. Um. Our total revenue was about twelve percent of our adopted budget. Um. This is because um

0:56:17uh, our property taxes are the city's biggest, largest income category. Those are received in December and April each year, so they are not uniform across months, or even across quarters. They are uh non-departmental. So they're not allocated to one department by comparison. Uh Last year we were at fourteen percent. We're right about uh little slight, very slightly below, but we also haven't received

0:56:41all of the revenues um in cash in hand uh that uh

0:56:45have been uh allocated to those prior quarters. So, going forward, you may see some different fluctuations in the revenue that's allocated to the previous quarter

0:56:55uh real property transfer taxes. Um, right now they're performing as reflected as you can see in update um the specific line. Item: right now we um what shows in the updated About five hundred, seventy, four thousand dollars that are the funds we perceive? Are not the funds that we have been reported by the county to receive by the end of September we expect to be actually at eight hundred ninety-two thousand um which is about twenty Um! The previous year uh was definitely

0:57:25higher than this. I think that this is reflecting exactly what we have been looking closely to monitor with real property transfer taxes. Um The latest um quarterly report we received from our tax consultants showed that the Median home price has dropped from one point four million dollars to one, two

0:57:45million dollars. So um still a very good number. So we're we're monitoring this very closely. Um! The report that I think Sandra um uh Mayor Protein Modiama had asked specifically about this, so I wanted to address that the report that Uh Sandra had reported the last meeting. I will have her update that for the next quarter, but that report also showed the July and August um totals, which that's what we have received today. So far, so it really hasn't changed. Much is, except for what we've actually received,

0:58:15so that that is still um. That report is still valid and still good. Um, otherwise we're like, I said, about twelve percent of revenues which were slightly below behind last year. And um, we're we're continuing to watch this. This is exactly why uh, these reports are timely and making sure that we're looking at these trends so that we can continue to report back

0:58:36um specifically after the next quarter. And then uh, when we come back at mid year for the adjustments on the expenditure side.

0:58:44Um! We are running at twenty one. So in a quarter you expect it to be about twenty five, so that is slightly below budget. Um, it's on track. Um Seventy-three percent of those costs are personnel as is common, and and has been common for quite some time. So, as the Council knows, we've been dealing with quite a bit of vacancy levels, and that is probably the biggest contributor to why we're uh trekking below budget at this time, so that may have to be offset by some over time by some

0:59:14consulting um uh contracts that we've been working with temporary uh staff. So we are filling in those blanks as best we can as far as the vacancies. But those costs may end up um

0:59:25kind of leveling out over time, and those we are continuing to monitor. But at this point we are in coming in under budget.

0:59:32So um again, This is uh the first quarter, and um we're tracking as expected for the first quarter. Um! It'll be uh once. The second quarter comes in. We will have in December we will be receiving our first um payment of the early uh property taxes, so that will really show us, I think, a better picture of where we're tracking for the full year. But that is something that again, we're keeping an eye on, particularly the transfer taxes, sales, taxes, or

1:00:00our training slightly um better than expected. But we again, this is just one of those things that we have been continuously working on, and with respect to um

1:00:11where we're at with the un audited um reserves from last year. Our audit is is commencing, and we're working with our auditors. Um! We're expecting that um probably about January will be able to have our act for, uh completed and ready to um, probably in January, February, be able to provide that to the Council, and we do have good expectations about where we've ended the year, as we've already shared

1:00:36um, and at that point uh, I believe those are all the highlights to cover um, and if the Council has any questions, i'm happy to answer them.

1:00:44Thank you. Any questions from the Council.

1:00:46I I have one. Um. So you manager? Um, could you tell us when Um, basically the amount of taxes that we receive in December will be final, or when you have a good sense of what the total amount is. When does that happen? Um, We usually sometimes get a bit of a preview, probably a couple of weeks ahead, and we work with our sales tax or our property tech

1:01:06They're the same consultants Hdl: companies. Um, but we usually receive that money about um uh December tenth uh the December um. We expect it to track exactly um pretty much exactly half of what uh we budgeted for, and it's about uh

1:01:25off the top of my head. It's about, I think. Nine point six million dollars, so we'll we'll We'll expect to get it half that. But we will find out for sure. Once uh we're able to get those receipts in hand, so that it's actually quite quick between, like the final date of the taxes and our getting are receiving them

1:01:44right right? We will definitely have that full total for the next quarterly up to It'll definitely be in and ready to um. We'll have that full amount. Um, for the next quarterly update at the end of the quarter. But for the end of the calendar year,

1:01:57Okay, counts over right now.

1:01:59Thank you. Uh two questions. First one in the revenues for both community develop and recreation. Um, if you can explain a little bit about the increase in activity there as far as revenue. So recreation. I know that this period of

1:02:15time covers the summer a little bit, so it probably get the tail end of camp. But it how we're doing as far as um

1:02:23of cost recovery from recreation, and then with community development, it seems like there has been an increase in revenue from there. So what that's attributed to, and what's been projected for the rest of the fiscal year.

1:02:37I know that Chris and Melanie are both on the call if they want to elaborate. Um, but um uh,

1:02:45that is, I believe, uh, particularly for recreation ahead of last year. Um! We that is absolutely true as far as Um. Some of the challenge of the summer after school registrations, camp registrations, things of that nature for community development that is definitely permit activity. Um. And you know that if uh

1:03:06Melanie: trying to look on the call to see Yeah, I'm: there we go. There's Melanie. Okay, Thank you. Um. So when I look today i'm just going to be pulling up the report right now. We're not actually ahead. We're kind of tracking um.

1:03:19So I think I looked at at the end of October, so I have to uh look at it here, but we but we are tracking, and we um, as you recall last year our revenues were ahead. Partly. It was an extraordinary amount of activity last year, and we'd also just done a uh

1:03:35I uh finally caught up to one hundred percent recovery on our permit costs

1:03:39after we have done a fee study a couple of years ago. But we're in about a quarter of the year we're about a quarter. This would normally be our busy season, and white rains are welcome. Um! And then ours ends up being impacted, and we did not budget for any large projects because they're on unpredictable. So what we do budget for is just the background activity that you would normally see amongst our our our single family, ten thousand households. Um! So I think we're we're on track, both in terms of revenue and expense. Independence.

1:04:09It comes in. We usually make that adjustment at at mid year.

1:04:14Um, so I should share that, you know. Last month, for example, we started to get behind literally as soon as uh one person's out for even a half day. We start to get behind it just uh our building official just told me today that we had

1:04:25that we've caught up. So. Um, I think we're just what is doing what we do um, and staying on track. But we do want to very closely if we if I start to see it. Not meeting expectations.

1:04:37Thank you, Chris.

1:04:41Melanie: Well, it will be one more thing also. Uh Bill, business licenses do come into our little head in one of our divisions forty, ten. But that is because our business licenses renew at the beginning of the year, so we usually start that one. Uh we, we get more of it, our rent registry and our business licenses at the beginning,

1:04:56but other than that, it's just a regular activity.

1:05:01So to our recreation practice.

1:05:03Chris Jones, Recreation Director: Thank you. Um. So in recreation um Council member, Red Nick um, You kind of hit it on the head when you talked about summer. Um! This past summer was a normal summer quote unquote normal summer uh the end of last summer

The City Manager presented the first quarter general fund update, standing in for the finance director.

Her framing: “not a lot of activity, which is very typical of the first quarter,” and the report is on a cash basis — what has actually been received by 30 September.

Why that matters: property taxes, the largest revenue category, arrive in December and April, so “they are not uniform” across the year.

Revenues stood at about 12% of budget, against 14% a year earlier.

Expenditures at 21% — against the 25% you would expect at a quarter — “so that is slightly below budget… it's on track.”

Why they were under: salary savings from vacancies, partly offset by consulting contracts and temporary staff “filling in those blanks as best we can.”

On the real property transfer tax, she was careful: it was “performing as reflected,” the previous year “was definitely higher,” and the county reported about $892,000 by the end of September against $574,000 shown; the median home price had dropped from $1.4 million to $1.2 million — “still a very good number” — so “we're monitoring this very closely.”

Asked when the December property tax would be known, she said it usually arrives around 10 December, about half of roughly $9.6 million budgeted; the audit was expected to be ready around January or February.

Rudnick asked about Community Development and Recreation revenue. Mintz said Community Development was not actually ahead but tracking, having caught up to 100% cost recovery on permits after a fee study; it budgets only for background activity, not large projects. Staffing was thin: “we started to get behind literally as soon as one person's out for even a half day,” though the building official had just reported they had caught up.

Significant

Expenditures below budget because of vacancies, partly offset by consultants hired to do the same work — stated in the first quarterly report of the year. The City Manager describes it as filling in blanks rather than as saving money.

12 Twenty-four percent in Recreation captions 401–430

1:05:21Chris Jones, Recreation Director: uh twenty, twenty One was Um! We were still operating with our um cohort model um! And so we did collect more revenue as a result uh this summer. Um! We are also outperforming revenue expectations at the swim center. We continue to have

1:05:39um high attendance. Um as well and so um we are tracking higher in revenue. We about about twenty-four percent

1:05:49of our budgeted revenues, which is higher for this time year, because typically we um collect the majority of our revenue at the end of the previous fiscal year.

1:06:00Um! And then expenses are higher than last year. But they that is in line with uh more activity. So we're at about twenty one percent uh of expenses for this quarter.

1:06:12Thank you. And then my second question

1:06:16that is, uh

1:06:18um

1:06:20in table, three for general fund expenditures. What would classify as other purchase services.

1:06:52Just one moment,

1:07:03I apologize. Let me. I can find the exactly what those items are in just a moment,

1:07:08and while Director Jones is still on the zoom call. Um

1:07:13I I It would be wrong with me to not my daughter is just so in love with all the services that the Recreation Department provides. We know that she's uh always there, and and thank you to all your staff, because um, it's not just. You know

1:07:28she is the one i'm connected to. But all of the kids who use the Lsrito services. Um, just it's the staff does such a fantastic job.

1:07:37So please pass that on to them.

1:07:40Chris Jones, Recreation Director: Thank you. I definitely will. They do do an amazing job.

1:07:54Well, uh city manager,

1:07:56if I may be here. Um is, are the other purchase services uh not including the annual insurance premiums. I was gonna say that is actually including our insurance premiums,

1:08:07I believe.

1:08:10sorry then i'm not able to pull this up quickly.

1:08:15Trouble finding my last.

1:08:19Chris Jones, Recreation Director: I can tell you that in general, other purchase services are

1:08:22telephone expenses,

1:08:25Internet software license legal notice and advertisements, printing and minding travel training. Yes, events and field troops.

1:08:35Thank you.

1:08:36Thank you. I apologize. Thank you, Chris, for that nice pinch. It. I appreciate that this is what happens from the finance director, but she's taking some of well deserved night after. Believe me,

1:08:47I appreciate it. Thank you.

1:08:51Okay, yes, thanks. Um. So some of the is uh discussion occurred dealing with the staffing and the current vacancies and the

1:09:03need to increase special services. Um, on the on table Four. I'm. Assuming that the administration's increase this year of actual, if that's the reason that it's

1:09:17so much more than the the comparison of last year.

1:09:21Uh, i'm sorry. Repeat the first part of what you said, the vacancies and temporary services. Yes, and also in administration. Um, we do pay insurance payments in July of each year, and that comes that is housed in uh the finance in this uh table, the way that uh administration contains finance. It's not separated out. Um. As a department, so finance is contained within administration and in finance and human resources,

The Recreation Director gave the revenue picture, and it was better than budgeted.

On the prior year: 2021 was still run “with our cohort model”; this past summer was “a normal summer,” and the department “did collect more revenue as a result.”

On the current year: the department is “outperforming revenue expectations at the swim center,” with “high attendance” continuing.

The figure: about 24% of budgeted revenues collected — “higher for this time year, because typically we … collect the majority of our revenue at the end of the previous fiscal year.” Expenses, in line with more activity, were at about 21%.

So Recreation's revenues were tracking higher than usual for the quarter, with the swim center outperforming expectations.

Significant

The swim center outperforms its revenue expectations, and Recreation as a whole has collected about a quarter of its budgeted revenues in the first quarter. Six weeks later the Council hears that the pool's own repair bid came in at more than double the engineer's estimate, and a councilmember objects to the argument that the pool having generated money entitles it to general fund support.

13 Premiums, and the auditor's advice captions 431–461

1:09:49we make our premium payments for general liability and for Workers compensation. So that's a big part of that thirty-four. But yes, that is in addition to um uh some temporary services that we have had to procure because of the vacancies. Okay, And I was gonna just generally ask you, since the State Auditor had suggest more emphasis on the department budgets, how that's working out this year. Yeah, no. And I think that even just having this conversation and having the Council be able to zero in exactly

1:10:18exactly on being able to ask those questions. What is the difference? What is the variance from last year? What does this include? Um, I think that

1:10:27you know that, is it? It's not just providing. You know us more information on how the departments are trending, but being able for the Council to compare, you know it's the same number from classification to department. But it's a it's a different picture of of where those uh expenditures well in revenues, for that matter, are coming in and happening so. Um In my view, I think that this has been a huge um

1:10:50uh improvement for all of us to be able to to track this much more closely and much more clearly um, and that we can be able to identify any trends that might need attention or take a look at over time what we've been able to do by department. So I think that this is um. This is exactly It's been very helpful to me to see that I was hoping it was the same for the department heads that it's a helpful process. Yes, we all hold each other accountable for that. Okay, that's good. And finally, I just wanted to

1:11:20ask about. I think it's been about a year that our Cannabis dispensary has been open, and when are we going to see the tax money, and how much will it be? And where will that be listed? So we can start tracking that as well. So we have. Just yeah, we have about a year. So we don't really have a lot of

1:11:37trends to report at this point. It has um as I shared with the Council um with uh, I I shared our first quarter sales tax um information that I provided to the Council. Um uh nug has already hit our top

1:11:52twenty um in just one here uh for sales tax. So that's uh that. That may tell you something right there. So it's definitely starting to reflect in our sales tax increase. Um. But we'll be able to identify a trend now that we have a couple of quarters to look back on, so that will be um. We're, you know, of course, that comes to the general funds, but we are trying to track um. We'll be able to track the payments that are made.

1:12:16Um! We have been tracking the payments that are made by the dispens. The one dispensary is open now, the other dispensary is still working. They have their billing permits. They're working, and we are hoping for them, you know. Fingers crossed that they'll be open within the next few months, and we'll be able to see um the benefits of. So by the next quarter we port we'll know how much

1:12:35I mean. Not just that it's in the general fund. But you'll be able to tell us how much, and in fact, um, because that money again is some of that will go to homeless issues. So that's There's another reason why that's critical.

1:12:52Just um The commit the community benefit money. That is indeed separate. That is a separate payment. We'd like to see that right? Right? So Um. So that's a that's a actually a good note. I will make a note that for the second quarter update we can in the same way that we've been able to parse that we've looked at. Um real property transfer tax. Perhaps we can prepare um.

1:13:18Be happy to do that.

1:13:20Okay, Anything else, Mayor for? Thank you, Mayor. Just a quick Follow up question on that back to city manager. Um! I thought that all the tax information that we receive is in aggregate, so that we would not be able to identify any single taxpayer

1:13:37right? But we can give the top twenty as long as we don't,

1:13:41put them in order, and as long as we don't um reveal exactly what that money is. But we are able to provide the top. Twenty uh and we do that actually each year in our um financial statements and in our budget, our top twenty-five um sales, tax generators, and top twenty-five employers

1:13:57just the names. Okay, so that they wouldn't be just that. Just there is no way for us to know it just all solely for the for the Cannabis Dispensary.

1:14:07Um, I can give you limited information about that, but I can give you um some of what um the aggregate is. Yes, okay,

1:14:16Yes, but we and and also to um Councilmember Fideli's point uh with the community benefit payment. Um. The first permit is a percentage payment. The second permit is a flat fee, So what we can do is we can provide

1:14:33uh, what that I believe what we would be able to to share is how much that community

1:14:47allocated to the Municipal Services Corporation is the Municipal Services Corporation met, and had the discussion once that funding starts to flow, and there is indeed a budget to be able to be allocated. Then the municipal services, the Council acting as the Municipal Services Corporation would then be able to allocate that many accordingly.

1:15:08Okay, Any other questions?

1:15:10Good. Um. Do we have any public comments?

1:15:15We do not have any public in the room, and I do not see any hands requesting to speak remotely. Okay, very good. Thank you. Uh. Next is uh City Council Council. We is on reasonably, is on the assignments. Any updates from the Council.

1:15:31Yes, um. Last month the uh West Contra Costa Transportation Advisory Committee, Whittak uh mentioned that their survey and um

1:15:43efforts to outreach to the various cities and agencies in West County concerning Sant Papal avenues of planning for the future. Uh the a report will be uh made, and we'll go to the tack here of which are

1:15:57um uh staff, is participates. But we will be getting something in the next three months to review and consider, as other cities will to to make some final decisions. Thank you.

1:16:08Uh any updates

1:16:11I want to check with Council Member April. Send any update.

1:16:14Thank you very much. Um. Let's see, it is

1:16:21eight.

1:16:22She is

1:16:24eight, seventeen. This evening that we are adjourned. The next regularly scheduled city council meeting is Tuesday, November fifteenth, two thousand and twenty-two at seven Pm. Have good night, Everybody.

A budget line was explained, and then the Council asked whether a reform was working.

What sits in the line: “our premium payments for general liability and for workers compensation — so that's a big part of that.”

Plus “some temporary services that we have had to procure because of the vacancies.”

Then the question: since “the State Auditor had suggest[ed] more emphasis on the department budgets,” how was that “working out this year”?

The answer pointed at the conversation itself: “even just having this conversation, and having the Council be able to zero in exactly on being able to ask those questions.”

The questions being: “what is the difference? What is the variance from last year? What does this include?”

In the City Manager's view it had been “a huge improvement” for tracking trends by department, and department heads “all hold each other accountable for that.”

Fadelli then asked about the cannabis tax. After about a year there was little trend yet, but Nug had already reached the city's top twenty sales tax generators; the second dispensary was hoped to open within months. The community benefit payment is separate, and the City Manager offered to break it out in the second quarter update as had been done for the transfer tax. Asked about confidentiality, she said sales tax data is aggregate: the city can list its top twenty-five generators by name, unordered, but not one taxpayer's amount.

Significant

The state auditor's recommendation to present department-level budgets lets councilmembers ask about variances by department, which the City Manager calls “a huge improvement.”
