A meeting soon after the November election. Mayor Lyman asks for a series of public meetings in 2017 for residents who do not feel heard, and a Measure B volunteer sets out how a library measure could reach two-thirds next time. The Council clears the way for Eden Housing's Hana Gardens to break ground and sets 2017 garbage rates, up about $2 a month for most customers.

It accepts the centennial task force's plan, a September gala weekend, an above-ground time capsule and $31,000, and approves exclusive negotiations with Mona and Conti Patel to buy the city's lot at 1718 Eastshore Boulevard for a business hotel of about 100 rooms.

These summaries are written with AI. An AI model (Claude, by Anthropic) drafted the summaries, titles and notes from each meeting’s closed captions, and they were checked against those captions. They can still be wrong, leave out something that matters, or weigh things differently than you would.

  • Captions are automatic and unedited. Names and words are often misspelled or misheard, and quotations carry those errors.
  • Who is speaking is often unclear. The captions rarely say, so a speaker’s name can be missing or wrong.
  • Not the official record. This is an independent site, not the City’s. For what was decided, rely on the adopted minutes.

Check anything that matters against the captions beside each summary, or the City’s recording. How these pages are made

0:10:03absolutely nothing to report from the closed session i also as your mayor went to the contra costa mayor's conference on october 3rd and had a very informational performance or presentation from the greenbelt alliance the greenbelt alliance is not more than just protecting the open

0:10:48okay um every election results in competition for rare resource of votes your votes competition creates advise adversaries that in el cerrito have more in common than not now that this election is over we start the hard work of rebuilding relationships trust and cooperation towards these

0:11:33values from all sides campaigns are educational opportunities for elected officials as a result of all the listening that occurs one of the themes i heard repeatedly in many uh is that is that many among us do not feel heard whether the issue is housing traffic parking marijuana

0:11:56development open space sports facilities library or education the education the election highlighted a strong desire for more public involvement a good adviser of mine recommends a series of meetings focused on getting the voice out she promotes restoring civility through

0:12:20communication and cooperation towards those goals we have in common i hope this and hope i support this and hope the council will support this as well i i encourage staff to work towards a series of public meetings this coming year on a variety of topics to provide el cerrito an opportunity to

0:12:41be heard as we the council revisit the city goals in 2017.

0:12:49in this campaign i heard many opinions about the same issues an agreement on some of these issues may be difficult but i hope we can listen to each other and work towards a better el cerrito with that i'm going to turn it over to assistant manager pink us to talk about the arts exhibit

Mayor Lyman opened the meeting with all members present; Mayor Pro Tem Abelson led the pledge. Quinto had presented a proclamation at the 63rd anniversary of the CME church, on behalf of the Mayor, who could not attend, and of the county. Lyman reported that the closed session, a performance evaluation of the city attorney, had nothing to report, and that at the 3 October mayors' conference the Greenbelt Alliance said it supports transit-oriented development as well as open space.

With the election over, Lyman said, the work of rebuilding relationships, trust and cooperation begins, and civil discourse is the best way forward. A theme he heard repeatedly in the campaign was that many do not feel heard, whether on housing, traffic, parking, marijuana, development, open space, sports facilities, the library or education, and he encouraged staff to work toward a series of public meetings in the coming year as the Council revisits the city goals in 2017. Assistant City Manager Karen Pinkos, for Suzanne Iarla, announced the Arts and Culture Commission's call for artists to show in the City Hall gallery, with submissions due Monday 28 November, and invited everyone to see the current show by the El Cerrito High School photography club.

02 Public comment: the library's next try, Deep Green, and a lateral captions 18–48

0:14:05so i encourage everyone to take a look at our wonderful gallery space of our student art thank you your honor great thank you any other announcements seeing none we'll move on to item three item three is oral communications from the public all persons wishing to speak

0:14:20should sign up with the city clerk cordels wants me to talk about the lights um remarks are typically limited to three minutes per person we have a lighting system that will help us keep you to three minutes um individuals wishing to comment on any closed session

0:14:37items should do so during that period of time if you're going to speak to a specific item like six or seven we would we'll take your comments at that time um yeah it's visible it's visible so at this time we'll open it up to public comments i understand we have a few

0:14:57people we have four speakers mayor so it'll be cordell hindler followed by michelle fideli howdy gowdy and al miller so uh mayor lyman and council members are in colorado handler richmond i did pass around um a new show uh that is just being held that country calls the civic theater called you can't

0:15:17take it with you and it's playing this friday evening and the tickets are 11 so that's one then the second one of um i came last month uh when i heard uh chair arzio's uh presentation on on how the crime prevention committee has been doing on their work plan i find his presentation

0:15:35exceptionally wonderful because it shows that that i have been helping him you know get in contact with someone getting these neighborhood watch groups up and running because for example from in my city of richmond we've had lo we have had a number of neighborhood

0:15:49watches uh in our city for a number of years and they're very helpful too because we get we'll be working with the police you know like to help track down uh what's what's been going on in in different areas so that's number two then the third one is um i have took a look upstairs in the in the

0:16:06in the art gallery space well before i came up here and it was like i have never seen this much talent in el cerrito kids it's like it is a mind it's a it's amazing how these how these kids can like to take pictures of ordinary things and uh and capture it on the display so

0:16:22i i love it any minute so that's number three number four is um let me see when i came uh also in the that same month i was like i was really inspired um how the how these kids you know like to go and work in like in the various fields you know like when we had in

0:16:38september i find it i find their presentation wonderful it's it's time that uh that these kids you know like think about their futures you know what what's gonna happen to them in like five ten years when they making like six figure incomes i figured this is an opportunity for kids uh for

0:16:54el cerrito stars for for next year so that's all i have great thank you michelle fideli followed by howdy gowdy good evening mayor lyman and council members my name is michelle fideli i'm a long time el cerrido resident i was a measure b volunteer this campaign

0:17:20season and i just wanted to thank the council and city staff for their efforts on this and i wanted to share a few things that i learned number one el cerrito does want a library over 62 percent of voters supported measure b and a lot of the people we talked to on

0:17:38the phone and door-to-door also said they want a library but they had concerns i believe we can easily get two-thirds by being responsive to those concerns cost estimates i think we can do a better job explaining the actual cost estimates sharing information about

0:17:55comparable projects in other communities and explaining why cheaper projects nearby are not accurate comparisons one being a branch library and one being a lease at a refurbished walgreens we also need to tell the community what would be given up if we choose a project

0:18:11at half the price location many people wanted more information about possible locations and el cerrito has several good options for locating a library each with positives and negatives they deserve discussion if funds are needed in order to secure location we need to explain that to

0:18:28voters and if identifying one specific location diminishes our negotiating position for purchasing that property we also just need to explain that transparency it seems to me that if we are putting forth a project that we're proud of we shouldn't be hesitant to say how we plan

0:18:46to pay for it so let's be completely transparent and let the voters decide community participation although the library issue was before the council several times and there was a great deal of information on the city's website i think we all could have benefited from a town hall meeting

0:19:02before measure b went to a vote the discussions on social media including facebook and next door were not productive in responding to legitimate concerns and we tried we did try people wanted information and i worked with wonderful volunteers who worked so hard to answer questions and provide

0:19:20details i hope the council and the city will work with all residents to bring the library back to the ballot soon i hope we won't let the opportunities for good locations slip away the library will be the heart and soul of our community and we need that now more than ever so let's talk to each

0:19:38other like neighbors and let's build a library in el cerrito thank you good evening mayor and council members my name is howdy gowdy i had a couple of different items so the first relates to 5l which is in consent but it's not going to really change how you need to

0:20:00act tonight i simply wanted to point out the opportunity that as there is construction and utility um work happening next door for the hannah gardens project it's it's potentially a good opportunity for the city to resolve um an issue that's come up before which is

0:20:19you know figuring out how to increase electrical service for you know electric vehicle charging because it's right next to the parking lot trenching and electrical utility work may be very synergistic with that project and i hope that staff will look into the opportunity of

0:20:39leveraging the opportunity to get some much needed infrastructure for the city at the same time another item is not directly related to the hundredth anniversary but i just wanted to bring up that um you know i hope that there will be an effort this year for the city's

0:21:00municipal electrical accounts to be 100 renewable energy the mce deep green option um you know our community has a sort of record number of resident adopters um mce has even pointed out to us that um ulcerity is unique in that all council members have elected to be

0:21:25deep grieving customers and electric power so i think it's an important statement for our city and climate action plan in the hundredth anniversary year to also choose city accounts to be 100 renewable and i know money has been budgeted for it in the past and i think it just

0:21:40hasn't uh happened or followed through so i hope that this year will be different and uh you know lastly i guess you won't be surprised to hear that i am still anxiously awaiting any uh feedback on your thoughts and actions regarding mitigating the impacts to the

0:22:03housing lost at el dorado street by the the condo development there and i think it's really important to continue to try to do something to to mitigate these impacts and i've suggested many things and i hope that each of you have things that you're trying to do and will

0:22:22follow up on that thank you thank you al miller good evening mayor lyman council members i'm here uh with a comment from steve sanitary district on uh agenda item 5d both the agenda item and the agenda and the public information the agenda bill addresses the line that's going to be built in this

0:22:52easement you're considering granting as a sewer line in most developments that build a quote sewer line in conjunction with them those sewer lines after the development is completed and activated get turned over to steed sanitary district and we maintain them and assume responsibility for them for

0:23:14their on in in this particular case this sewer line is actually the lateral of eden housing and although it's referred to as the sewer line it is their lateral and therefore it will not be turned over to stage and the eden housing or whoever is their agent will maintain and repair it and be

0:23:37responsible for it as long as they have it i just wanted to make a technical clarity on that thank you any other speakers right that concludes item three oral communications from the public we'll move past item four presentations we have none this evening to item five

Cordell Hindler of Richmond promoted a civic theater show, praised the crime prevention committee chair's report, saying he had helped get neighborhood watch groups going, and the student photographs upstairs, and hoped EC STARS would build on the students' September presentation. Michelle Fadelli, a Measure B volunteer, said El Cerrito does want a library: over 62% of voters supported Measure B, and she believed two-thirds could easily be reached by responding to voters' concerns: better explaining the cost estimates and why cheaper nearby projects, a branch library and a lease in a refurbished Walgreens, are not accurate comparisons; discussing possible locations; being transparent about how it would be paid for; and holding a town hall before the vote. She hoped the library would return to the ballot soon.

Howdy Goudey suggested using the utility work for the Hana Gardens project next door (item 5l) to add electrical service for electric vehicle charging by the parking lot; urged that the city's own electricity accounts go 100% renewable on MCE's Deep Green option in the centennial year, noting MCE had pointed out that all council members are Deep Green customers and that money had been budgeted before; and said he was still awaiting the Council's response on mitigating the housing lost at El Dorado Street to the condo development. Al Miller, for the Stege Sanitary District, clarified that the line in the easement under item 5d, although called a sewer line, is Eden Housing's own lateral, so it will not be turned over to Stege; Eden Housing or its agent will maintain it.

03 Consent: Hana Gardens can break ground; a 430-foot lateral captions 49–63

0:24:01adoption of the consent calendar we have 12 items i guess l would be 12.

0:24:09item 5a approval of minutes item 5b set the schedule for january city council meetings we will be canceling the january 3rd city council meeting due to lack of business item 5c agreement with west coast arborists for tree pruning services 5d as was just discussed is the easement

0:24:30for eden housing 5e is participation in the california uniform public construction cost accounting act 5f amendment of professional services agreement 5g services service agreement for neogov 5h annual review of investment policy thank you to the financial advisory

0:24:50board five i economic development committee appointment 5j another economic development committee appointment thank you for those that are serving and 5k quarterly investment report and finally 5l approval of revised first amendment to the disposition dis developed

0:25:08disposition development and loan agreement with eden housing for city housing property located at 10 8 4 8 and 10 860 san pable avenue approval of the agreement with eden housing regarding california department of housing and community development affordable housing and sustainable

0:25:27communities grant and approval of the housing and community development infill infrastructure grant this is the 5l i want to highlight because it this was something that was started several years ago and the decision that will come tonight will allow ground to break uh next door

0:25:50soon so i just want to make sure that everyone understands the milestone that um this action will will be uh does anybody want to pull anything id 5d okay so i'm looking for move adoption of items five a b c e f g h i j k n l second motion by ableton second by freedman

0:26:20all those in favor please say aye aye opposed abstentions um let the record show past unanimously um did 5l need a separate vote no okay all right um let's take up item 5d at this time hi good evening mayor lyman and council members my name is melissa tiggbao i'm

0:26:53the engineering manager and senior engineer for the public works department this item is asking council to adopt a resolution to grant else radio senior lp which is an affiliate of eden housing and access and utility easement and authorizing the city manager to execute

0:27:12the easement deed and maintenance agreement this is for sewer line improvements for hannah gardens apartments which is located next door great councilmember bridges i just had my question was to address what mr miller addressed regarding stage in the lateral line

0:27:34versus sewer line could you clarify correct so this is really going to be a force main which is going to run along the existing main that stage has control of but this is more of a treatment like it's treated like a lateral so it will be a privately owned lateral

0:27:56that comes that is essential for eden housing to operate right thank you so will not be adopted will not be owned or maintained by the city right so it it's my understanding that the you know each resident owns the lateral from their house essentially to the sewer line

0:28:12that's in the street um so based on this the fact is that there's no there's very few residential facilities along this block of kearney is there just no is there no sewer on kearney and and therefore this lateral needs to go all the way out to schmidt is that that's essentially

0:28:35so an instead of a 20 foot or 30 foot lateral that most homeowners might be familiar with this ends up being a 430 foot lateral correct it's a foreign it's approximately that and basically it has to um it's because of the elevation and it needs to be forced up to meet a

0:28:55main which is located on got it so it's a pressurized system yes okay great any other questions no thank you thank you i move out in 5d second motion by friedman seconded by abelson all those in favor please say aye aye opposed abstentions let the record show it past unanimously thank you

The 12 consent items included canceling the 3 January meeting for lack of business, a tree pruning agreement with West Coast Arborists, a NeoGov service agreement, the investment policy review and two Economic Development Committee appointments. Lyman highlighted item 5l, the revised amendment to the agreement with Eden Housing for 10848 and 10860 San Pablo Avenue, with the state affordable housing and sustainable communities and infill infrastructure grants: started several years earlier, it would allow ground to break next door soon. Abelson moved the calendar without 5d, and Friedman seconded.

On 5d, engineering manager Melissa Tigbao asked the Council to grant an access and utility easement to an Eden Housing affiliate for the sewer line for the Hana Gardens apartments. Answering Bridges, she said it is a force main that runs along Stege's existing main but is treated as a privately owned lateral, not owned or maintained by the city. A councilmember established that with no sewer on Kearney, the lateral runs out to Schmidt, about 430 feet, pressurized because of the elevation. Friedman moved 5d; Abelson seconded.

Outcome CarriedunanimousConsent calendar (without 5d) adopted unanimously; the 5d easement approved unanimously.

04 Garbage bills up about $2 a month, and why captions 64–90

0:29:24all right that brings us to item six uh public hearing for our proposed integrated waste management fees and east bay sanitary garbage and green waste collection and processing rates effective january 1st 2017 staff will make one presentation after which the city council will initiate two

0:29:48separate public hearings the first public hearing involves proposed integrated waste management fees the 7 second public hearing is for east bay sanitary collection disposal and processing rates the city council will provide an opportunity to hear testimony from the public regarding each item

0:30:06if you wish to speak and have not submitted a speaker slip please do so at this time uh remarks are going to be limited to three per three minutes per person when we do get to the public comment after everyone has had an opportunity to speak uh at each public hearing we will

0:30:21make a motion to close let's begin with our presentation ms sanders thank you good evening mayor lyman and members of the council i'm maria sanders and i am the manager for the city's operations and environmental services division tonight we will be holding two public

0:30:39hearings in order to set rates for our solid waste and recycling services our division manages the city's curbside recycling programs and the city's recycling center and we also oversee the contracts for garbage and green waste collection disposal and processing with east bay

0:30:59sanitary and our who's our franchise waste hauler and republic services who's the post collection processor and i'd like to acknowledge mark figoni who's the president of espace sanitary here in the audience today our solid waste services are funded by three different components on our

0:31:24residential and commercial garbage bills they include an integrated waste management fee which funds all of the recycling services provided by the city a per service rate for the collection of garbage and green waste by east bay sanitary and a pert on disposal of

0:31:44process and processing rate for um by republic services the rates and the fees for these three components are based on the annual revenue required to run the operations that provide these services and for east bay sanitary and republic services this is calculated based on

0:32:06requirements contained in our contracts with both companies each year staff reviews any requested revenue adjustments for accuracy reasonableness and consistency and we also use the services of r3 consulting which is a waste management consulting firm to provide an extra pair

0:32:26of eyes on in reviewing the rate applications to verify that they are according to the established methodologies and our agreements and i'd also like to acknowledge at this time garcholt from r3 is also in the audience and may be able to answer some questions later on

0:32:46tonight we are requesting adjustments to all the components of the solid waste rates first i'll start with the city's integrated waste management fee the iwm fee funds the city's curbside recycling services all the drop-off services at the recycling center and also the services provided through

0:33:10recycle more which is our regional solid waste authority in the city's adopted biannual budget the iwm fees were projected to increase by about five percent this year and this was mainly to cover normal annual increases in personnel costs the addition of the environmental services management

0:33:32analyst whose salaries split between the iwm fund and the general fund and the replacement of a forklift and the lease purchase of two recycling trucks that will help us replace our aging fleet the recycling trucks are now eight years old going on nine years and they've made

0:33:57more than 1.3 million stops each which means that the lifts and the compactors and all the other moving parts are being used at least this much and they're beginning to show the signs of this use so shifting to the other components of the garbage bill the city council also set the maximum

0:34:19rates for east bay sanitary for the collection of the garbage and green waste as well as the maximum rate post-collection rate for disposal and processing of waste compost and c d debris as the various facility facilities operated by republic services as mentioned before the formulation of

0:34:43these rates is based on the revenue requirements from for each service which is calculated based on the formula stipulated in our agreements the revenue requirement for both these operations did go up this year and as you may recall last year in 2016 e-space sanitary did

0:35:03not raise its rates or did not request a rate adjustment even though the revenue requirements for both collection and disposal did go up this was due to an over collection of revenue in in prior years and mostly due to unforeseen increases in debris box services provided by east bay sanitary

0:35:28and um so in the franchise agreement we have a balancing account mechanism which offsets the difference um between the annual revenue requirement um and uh the actual revenue that's collected through the rates for um and additional services so last year in 2016

0:35:49this was used to defer any increases in both the collection and the disposal rates thus the rates stayed at their 2015 levels this year however there's a lesser amount of the over-collected revenues to offset rates for this year and so to a certain extent the 2017 rates are absorbing a

0:36:12portion of the difference between the 2017 revenue requirement and the 2015 revenue requirement [Music] so this is what the new rates will look like for the different customers served for the majority of the customers which are those with the 20 gallon in the 35 gallon garbage

0:36:35service the monthly garbage bill will go up to by about two dollars a month more or less for customers um for all customers this increase in the monthly bills averages between six and seven percent um and now it's important to note that only about four percent of this percentage increase is

0:36:58driven by a change in the um in the revenue requirement the other one um 1.8 percent of the increases due to our success in diverting waste from the landfills um with the upsurge in economy waste to landfills is going up through the um throughout the state and in our region

0:37:24and in el cerrito as you can see from the 2006 bar on the right of the screen the overall tonnage appears to be going up but you can also see that the amount of trash which is the blue part portion of the bar is not growing so we are pretty much staying fairly stable about the amount of trash that

0:37:46we're sending to the landfill even though overall waste you know solid waste generation is going up and that's because the recycling green waste and c d processing is taking up the slack in addition more and more customers are migrating away from the 35 and the

0:38:0864 gallon garbage service to the 20 can the 20 gallon mini can service which is a really good thing but and even though this trend is beginning to slow down the migration too many count accounts is still growing by about three percent a year um and this indicates that more and more

0:38:27customers are really taking full advantage of our of our integrated waste management services but in terms of the rates it also means that the fixed cost to provide our solid waste services needs to spread out over fewer solid waste tons and over a greater number of customers who

0:38:50pay less for monthly services so to conclude these graphs tell the story that el cerrito is doing a great job in reducing solid waste going to the landfill and the proposed 2017 iwm fees and the east bay sanitary rates will continue to support these recycling and waste

Operations and Environmental Services Manager Maria Sanders explained the three parts of a garbage bill: the city's integrated waste management fee, which funds its recycling services and recycling center; East Bay Sanitary's collection rate; and Republic Services' disposal and processing rate, each set from the annual revenue required, with R3 Consulting reviewing the rate applications. The fee was projected to rise about 5%, for normal personnel increases, an environmental services analyst shared with the general fund, a replacement forklift and the lease-purchase of two recycling trucks; the current trucks are going on nine years old and have made more than 1.3 million stops each.

In 2016 East Bay Sanitary did not request an increase, because a balancing account held revenue over-collected in prior years, mostly from unforeseen debris box demand, so rates stayed at 2015 levels; less was left this year. For most customers, with 20- and 35-gallon cans, the bill would rise by about $2 a month, an average of six to seven percent for all customers, of which she said about four percent came from the revenue requirement and 1.8 percent from the city's success in diverting waste. Trash sent to landfill has stayed fairly stable while overall waste grows, and customers moving to the 20-gallon mini can, still about 3% a year, spread fixed costs over fewer tons.

05 Paying for less trash: every-other-week pickup and new rate structures captions 91–114

0:39:15diversion services so thank you for your time and i'd be happy to answer any questions all right i'm looking to my right any questions see none questions questions questions i have too um so my first question is all single family homes have to have pick up or charge for pickup whether

0:39:38they put a can out or not yes uh-huh and um i don't think unless they ask for it there's there we do have an exemption process but it's fairly rigorous that's what i just wanted to clarify that that service is not mandatory um there isn't there is a process within the municipal

0:39:56code to obtain an exemption but as miss sanders said it is strenuous but it is available and i don't think my experience is unique i have a small can sometimes i have a little bag a teeny little bag i feel guilty just putting it out on the curb because there's hardly

0:40:17anything in it i don't know about the rest of you or people out here but um because we're recycling so much more particularly with the green waste i mean that's when i saw a big change you know table scraps things like that um and i try to not buy things that have a

0:40:37lot of packaging but because we do you think that there's ever a point in time that we could have blue cam pickups like every other week it's a possibility definitely to you know look at that i mean i'm sort of surprised that we don't see that graph going down a little bit with the regular

0:40:58trash because it seems like my personal experience is i have very little trash yeah and bear in mind that a lot of it's also um that trash is also coming from uh construction even though there is c d debris it's coming from commercial accounts there's an increase in

0:41:15commercial accounts there's still a lot of diversion opportunity in businesses which i mentioned in my report so so some of that graph is due to the increase in in just economic activity that is happening around here and do you think that we're seeing a little bit

0:41:34better an improvement in multiple multi-family homes with their recycling efforts and also business um we are working we're doing some more technical assistant on it there is i would say that there is improvement there is a greater understanding that a multi-family and commercial businesses

0:41:56are more and more going to be required to do mandatory organics recycling mandatory commercial recycling and but it there are a lot of technical burden and technical [Music] barriers to doing it as easily as you can in the residential you know the single-family

0:42:17residential sector so more technical assistance is definitely required um so um you know there's tenants that have turnover there's employees that have a turnover it's a little bit more handholding thank you and so i want to follow up on one of councilman bridge's questions with regards to

0:42:38service not being mandatory for those that are completely composting their green waste and therefore not not generating as much of a weight burden at their address what's the process so they still need we they still want to take advantage of the recycling but they might they could

0:42:55obviously direct call that but they want to take advantage of the garbage and recycling pickup but not composting is there a way to get a refund or a deduction in bills as a result of not using some of the services you know i might defer that question to mark fagoni

0:43:12so so in essence if we take away their their green can can they get a discount uh that is always something that the pardon me mark figoni president east bay sanitary that's something that we could always look at in the future the way we're set up right now and as is common in the

0:43:29industry we're a three-cart system the costs have to be spread the cost the way they're assessed now is on the garbage can to start a system like that where we would give credits for the green waste can would require a complete new look at how we assess all of those fixed costs

0:43:46for running three trucks down the road for each resident once a week and it's i mean it's certainly it's always possible but it would it's not common in the industry yet and but it's something that i guess we could do at some point mr figoni since you stepped forward

0:44:02i'll ask the question because obviously i serve on the regional waste authority and that is something that you know water the water purveyors have the same issue with regards to the same fixed cost but they're selling less water during a drought here we are you know we're doing our job

0:44:21we're reducing the amount of garbage that's collected and that is the in you know lack of better terms that's the water that that's the metric that we're charging on at some point and i'm asking you to pull out your crystal ball you've alluded to it already we're going

0:44:35to have to change how we charge because ideally there will be no trash um to for us to bill against years from now but in your you've alluded to it that there we might have to venture into a new way of of billing for garbage can you think about talk about what the industry

0:44:54is is thinking so that we can start being exposed to that concept so that two three years from now we might be better equipped to move that way well i i have to say i i sit on a board of directors for the california refugee recycling council so i have frequent interaction with

0:45:14many of the haulers around the entire state both north and south this is a question that's come up we've addressed it as an issue but quite frankly this there isn't enough of a move there yet where anybody is talking about it we're as an industry we're we're working on

0:45:33uh meeting you know the new mandates for all of all of the uh the recycling the requirements uh the the the the various bills that come down and changing the rate structure has not been there hasn't been a serious discussion yet as i said it's always possible we

0:45:48can talk about how we can charge a rate for the recycling can a rate for the green waste can a rate for the garbage can but still i don't know how that eliminates that fixed level of cost some cans are going to go down some cans are going to go up we can certainly do

0:46:05it but there is an overall cost to move the products and and certainly like councilman bridges pointed out the number of times a truck is on the street is a good component of that cost if if we can go down the street only every other week for what little garbage we generate that

0:46:26could be a cost savings at some point so thank you for your testimony tonight um i don't know if anybody has any additional questions any additional comments good my pleasure thank you great thank you um ms sanders are you you're you're done i'm done excellent thank you

Bridges confirmed that single-family homes must pay for service, with a rigorous exemption process; with so much recycled and composted, she puts out very little trash, and asked whether pickup could someday be every other week. Sanders said that was possible to look at, and that landfill trash also comes from construction and a growing number of commercial accounts; multi-family and commercial recycling is improving as mandatory organics and commercial recycling arrive, but needs more technical assistance.

A councilmember who serves on the regional waste authority asked whether households that compost could get a discount. East Bay Sanitary president Mark Figoni said the costs of the three-cart system are assessed on the garbage can, so credits for the green can would need a whole new look at fixed costs and are not yet common in the industry. Pressed, as with water agencies selling less water in a drought, on how billing must change as trash shrinks, he said the industry had not yet seriously discussed changing rate structures, but agreed that fewer truck trips, such as every-other-week service, could save money at some point.

06 Two hearings, two rate resolutions captions 115–125

0:46:42so we have to as i said earlier we have two hearings tonight the first public hearing will be on the integrated waste management fees are there any comments or questions from the council on the integrated waste management fee which is before us on this board um

0:46:56it's also on the screen um and it talks about the cost the proposed 2017 costs per um container no questions we'll okay are there any uh public comments on this item i have one speaker slip i don't know uh do we have to officially open uh sure we will now open the public hearing

0:47:23and hear comments from the public there i've done it one one speaker one speaker cordell hindler not sure whether it's for the integrated waste management fees or the east bay sand someone needs to wake cordell up cordell he's sleeping yeah he fell asleep car down calling core down

0:47:46thank you all it's about the integrated waste management fees do you have a comment on the the price per cart or price per can for the integrated waste management fees yes also now go to handler richmond i was i was looking at this uh and i'm thinking this is this is not such a bad

0:48:21idea so i'm thinking okay i have some concerns regarding this matter so although i think it's a good idea so that's all great thank you sir uh i would entertain a motion to close public hearing i'm going to close second okay it's been moved by miss bridges and mr quinto and

0:48:42seconded by uh miss abelson um all those in favor of closing the public hearing please say aye aye any opposed abstentions great any additional comments on the integrated waste management fees if not we i would entertain a motion um we have two motions tonight correct

0:49:07yes yes so this would be a resolution of the city council of the city of el cerrito fixing and setting the integrated waste management fees effective january 1 2017.

0:49:17can i get a motion to that effect second i have a motion by uh friedman seconded by quinto all those in favor please say aye aye opposed abstentions let the record show it passed unanimously all right now onto the second hearing of this evening um we will now have

0:49:39a hearing with regards to the east bay sanitary rates [Music] can i'm going to open up the public hearing to hear comments from the public at this time i have no request to speak mayor great thank you can i have a motion to close the second hearing second uh motion by friedman seconded by

0:50:01abelson all those in favor of closing the the hearing on east bay sanitary rates please say aye aye opposed abstentions okay we've closed the public hearing any additional comments at this time if not i'm looking for a resolution of the city council of the city of el

0:50:20cerrito establishing maximum allowable rates for the collection of garbage and green waste effective january 1 2017. so moved back moved by bridges seconded by friedman all those in favor please say aye aye any abstentions or opposition all right let the record show it passed

At the hearing on the integrated waste management fees, Cordell Hindler thought it not such a bad idea, though he had some concerns. The Council adopted the fees effective 1 January 2017 on Friedman's motion, seconded by Quinto. No one spoke at the hearing on East Bay Sanitary's rates, and the maximum rates for garbage and green waste collection were adopted on Bridges' motion, seconded by Friedman.

Outcome CarriedunanimousIntegrated waste management fees and maximum East Bay Sanitary rates for 2017 adopted, each unanimously.

07 The centennial: a September weekend, a time capsule, and $31,000 captions 126–151

0:50:40unanimously um thank you miss sanders that concludes item six public hearing we'll move now to item seven which is policy matters um tonight's policy matters we have two one is the centennial celebration task force recommendations and the second is the exclusive negotiating rights

0:51:01agreement for mona and kante patel for 1718 east shore boulevard at this time we'll take up item 7a um please i'm sure you have a presentation welcome back do you still speak um californian i do all right that's just cajun not just cajun i i did get called suzanne a few times

0:51:26which i didn't mind so uh good evening mayor and council members my name is suzanne ehrler and i'm the assistant to the city manager and with me tonight is joanne stickbytes she's the chair of the centennial celebration planning task force um so as you are aware next year 2017

0:51:50will be the 100th anniversary of el cerrito incorporating as a city and so earlier this year the city council established an advisory task force to help determine how best the city should celebrate this anniversary the advisory body has been working since february of this year

0:52:15researching uh ways other communities have celebrated their anniversaries and centennials soliciting ideas from the community holding community meetings and outreaching to organizations and and groups uh the task force has come up with uh a number of suggestions that they're

0:52:36recommending to the city council and i've broken those into uh four basic elements and one of those would be to host a weekend-long community celebration in september and i'm actually going to pass the microphone over to joanne to give you a sense of the vision that the

0:52:52task force has for this series of events the um gala weekend will start september 15th in the evening we're not quite clear what we're going to do yet but it will be something in the cerrito vista park a movie it might be the poet laureate there will be music then on saturday we

0:53:15will have a parade it's going to be called el cerrito showcase parade in that parade we're going to be showcasing everything great about el cerrito including the stage vehicle and just all sorts of things the best speller in el cerrito all sorts of things all the mayors

0:53:34and then and also chalk art will be having that for the children and in after the so the parade will start at del norte it will come up it'll end up at cerrito vista we're going to have an emcees there who are going to introduce all the people that are coming into the parade

0:53:50and then we're going to be supplying lunch to the first thousand citizens a light lunch a cupcake and uh a ball of water we're gonna have music there that concludes saturday and then on sunday we're going up to mira vista for a ticketed event where there will be a

0:54:08program and a gala event mira vista thanks to donna hauser got the place for free for us so that'll be that's going to be our gala weekend thanks joanne so the other elements of the task force's recommendation include um to for the city to incorporate a centennial

0:54:30theme or element into events that we're already planning to host we either host annually or we will be holding in 2017 as well as to encourage community groups to host their own activity during 2017 and the city would be able to promote those centennial events through

0:54:48online publicity in city brochures and other advertising mechanisms the centennial task force has actually already outreached to a number of community organizations and attachment 3 in your report is a preliminary list of over 75 activities to be held next year

0:55:08throughout the year and they range from tours talks walks open houses entertainment events all sorts of different things so there's definitely going to be something for everyone during the year of 2017.

0:55:26the other large element that the task force is recommending is that the city create a time capsule and what's been discussed is actually an above ground time capsule that would be located inside city hall so it's not something to be buried in the ground that people

0:55:4150 or 100 years from now forget where it is so this photo that you see here is actually just an example of a indoor above ground time capsule from another city hall the details for the time capsule haven't been fully fleshed out by the task force but a proposed and preferred location would

0:56:00actually be the vestibule which is the small room that you come through to enter into the council chambers here at city hall so the the fourth element that makes up the budget request tonight is actually coordination and publicity um so advertising for the city events and

0:56:19helping to publicize the events held by partner groups a passport activity where community members would be able to to get a stamp or sticker or signature when they attend various events and at the end of the year they could turn in their passport for a prize and other elements so what's on the

0:56:36screen before you right now is the request from the task force which is for a total of thirty one thousand dollars but because the majority of the activities will be in the next fiscal year um the resolution before you tonight is actually asking for eight thousand dollars in the current fiscal

0:56:54year and twenty three thousand dollars next fiscal year so if you have any questions uh we are happy to answer those for you mr friedman yeah on the uh can we go back to the budget thank you for the gala that's going to be a ticketed event so aren't we going to

0:57:17have revenue to offset that cost or that's the estimated cost above what we recover in tickets that is the estimated cost above what would be covered by tickets so this would go towards the band and the emcee and decorations um coffee that type of thing but the um

0:57:34the dinner and some other charges related to the event would be purchased through through a ticket for each person attending okay uh was any consideration given to trying to get probably the most famous son of el cerrito john fogarty of credence clearwater revival to do a

0:57:54100th anniversary concert um yes it has been discussed his his rates are his going rates for other communities as well he did not uh he wasn't interested in giving us a well his management firm wasn't interested in giving us any type of price break um we certainly could uh attempt to contact

0:58:15him again um he did put a biography out recently so maybe instead of a concert we can ask for a book signing or something i'm not sure okay glad to hear that you explored it i did myself years ago and his management is not easy to deal with question no if he had a good time while

0:58:35he was here maybe he's got bad memories yeah leave it uh questions great um i want to thank the centennial committee for all their hard work on this i know that you put a lot of work into the background of some of these numbers these numbers weren't picked out of thin

0:58:55air and that you did base these numbers on solid work and and research and estimations that of the events themselves so thank you for that um any additional questions at this time before i go to public comment all right so thank you and we'll go to public comment at this time

Assistant to the City Manager Suzanne Iarla and the Centennial Celebration Planning Task Force chair, Joanne Steck-Bayak, presented its recommendations for 2017, El Cerrito's 100th year as a city. A gala weekend would open on the evening of 15 September at Cerrito Vista Park, perhaps a movie, the poet laureate and music; Saturday would bring the El Cerrito Showcase Parade from Del Norte to Cerrito Vista, with chalk art and a light lunch for the first thousand; and Sunday a ticketed gala at Mira Vista, whose space Donna Hauser secured for free.

The task force also recommended centennial themes in the city's existing events, promotion of community groups' own events, with a preliminary list of over 75 activities, an above-ground time capsule inside City Hall, preferably in the vestibule to the chambers, and coordination and publicity, including a passport to stamp at events. The request totaled $31,000: $8,000 this fiscal year and $23,000 next. Friedman learned that the gala budget covers the band, emcee and decorations above what tickets cover, and that John Fogerty of Creedence Clearwater Revival had been considered for a concert, but his management would give no price break. Lyman thanked the committee for basing its numbers on solid research.

08 A centennial tree, mayors' portraits, and the plan adopted captions 152–182

0:59:21so uh cordell handler richmond thank you suzanne for the a wonderful presentation um as you know i have been helping the the centennial task force you know i shared some pictures of the of some of the galas that i've seen uh in the in previous years so i sent one

0:59:38to one in in san francisco where they had their gala um a few months ago and it was a very well attended event so i'm thinking i can just i give examples to the task force committee at their at their monthly meeting so which is i'll be happy to um i've been happy to do that for a long time so

0:59:56that's it thank you any other speakers no mayor great i'll bring it back for uh comments i don't know if anybody has any comments yes i do i want to echo what you said i think the committee's done a terrific job and you know it's appropriate size event right it's

1:00:15not so ostentatious or extravagant that our citizens would think we're not being prudent with taxpayer dollars but it's festive and has something for pretty much everybody so thanks for all your great work to all the committee members and for the two of you i want to point out

1:00:36for those that are at home and may not have the agenda item i want to point out that there is actually something in every month and uh there's almost every single committee in our system has will be contributing their time and efforts to make sure that we celebrate our 100th anniversary well

1:00:54um i do want to echo uh mr gowdy looks like he's gone but i do want to echo him uh going 100 green in our 100th year uh does sound pretty good so i want to make sure if we're not already deep green that that's something that we definitely consider in our our budget

1:01:12um and i understand council member abelson you have some comments yes i do or just a comment question um last night i was at the tree committee meeting and i mentioned that we were going that this would be our centennial year and they came up with what i actually

1:01:30thought was a really interesting idea of having a centennial tree planning um and so i use that by way of example they're going to talk about it at their next meeting and decide upon the details of what they would like to do but i can see that throughout the year other groups

1:01:51might also come up with ideas and i'd just like to know that should they should this happen and should they be reasonable ideas that there's a way to incorporate them assuming that the committee or group itself bears the cost definitely definitely we'll be able to

1:02:09incorporate other ideas um that we don't know of yet that come to us during the year um a lot of the information will be online which is obviously easy to update you know very quickly and then we'll have a calendar that's an overview of the whole year but we'll probably also

1:02:25have either monthly or seasonal calendars that get into more details about all the all the various events so we can certainly um add more events during the year and it's it's great to have more partners whether they're advisory bodies of the city or their community groups

1:02:41thank you so if they in fact uh if some group or if someone had an idea who should they tell about it you okay one comment timing-wise with that and and the martin luther king celebration we're going to be passing out the year schedule so if someone wants to be on that year's schedule i mean they

1:03:05can go to the website but if they have a year's schedule in their hand they put it in the refrigerator to see what they're going to do in this month if we don't have it by january 1st then they won't be on that schedule right so i would encourage anybody who does want to do that to get

1:03:21it in real soon the issue i think is that some groups may not know of it's happening until later say i'm just speculating that the with the tree committee in this specific example they're going to bring it up at their next meeting which will be i believe in december

1:03:42and so they would be able to make that deadline should they choose to i think what they want to do is a fairly straightforward thing and without having heard them thoroughly discuss the idea yet but the um so it would be easy to you know include it and it seems

1:04:04perfectly natural to me it already at this point that we have a centennial tree you know were we all to be alive a hundred years from now wouldn't it be neat to see a centennial tree right it'll have to be one of course that can live that long but um anyway i you know there are other

1:04:23things too but i was envisioning on arbor day 100 oak trees being planted in the shape of a 100 you know several in the line and a bunch in two circles you know who knows how they would grow um the uh but but i would i bring this up to to ask staff to make sure that all

1:04:43the liaisons put this on the agenda um for the next meeting since i do concur that timing is of the essence we would like to have it printed so if it could please be put on all of the committee agendas they can always pass on the opportunity to comment but if it's not on their

1:05:00agenda they won't be able to take action in a timely manner so if we could please make sure that all the liaisons are informed that they should put this on their agenda make sure that it's known and if they have any ideas that that they work on it on those evenings

1:05:16i'd also like to thank the committee for all the hours that i know you've already put in not to mention the ones that i'm sure you will be putting in on in the future and i want to thank you all for that and i see that there's several members here there's at least

1:05:36two that i'm seeing right now donna houser your co-chair is in the back and i don't i thought i saw somebody else but maybe not uh right now and i there's a whole team of people that that's uh doing a lot of work and thank you uh i have two more quick questions back

1:05:57to the budget please uh what are the mayoral portrait signs ah second line down don't describe them let me do it you know in the martin luther king parade how they have those oval pictures of martin luther king and people carrying them well the historical society

1:06:16is getting together trying to get together all the headshots of all the mayors that have ever you know ruled the city and so we're trying to there's going to be a lot of photoshopping a lot of graphic artists and so but our goal is to have a big oval the date and the name

1:06:32that they were mayor and then have someone carry it in the parade that can also be used you know as a display in other areas after the parade as well but it's to represent everyone who served as mayor in the city and when do you hand out the rotten tomatoes that could be a fundraiser yeah yeah

1:06:53mayor freeman are you saying you don't want to carry your own head you can carry mine i'll carry yours okay and we'll see who dodges the best and then the web page domain name is like 20 30 bucks a year is that also like a logo we'll use for other stuff because just designing the

1:07:13header for a web page doesn't seem like a thousand dollar item it it probably won't reach that amount but we wanted to make sure that we asked enough in the budget that we were comfortable it will be something we can use for other graphics or just for that web page

1:07:28um so there's actually in your packet on the page that has the budget i actually don't think i have it in my yeah i didn't see it in your presentation in my powerpoint though there is a centennial version of the city's logo um that was designed by a local resident scott hauser and then

1:07:47there's also another graphic element um that we could use on promotional products as well so those wouldn't necessarily be just for the website the the header design on the website is actually changing the uh photo collage that's on the top of the page if you're familiar with our

1:08:08website now the main page has a different photo collage than recreation and then the public safety pages and so we would actually want to update the look um for the centennial year of the the main page for the website thank you i'll move item 7a let me have a second let me just look at

1:08:34it make sure that we don't need to read any of the details of it i think we're safe not reading the details right [Laughter] a second no sorry segmented by quinto you can't get a third second in there uh motion is made by friedman seconded by quinto all those in favor of uh our

1:08:54resolution the city council accepting the recommendation of the centennial celebration task force please say aye aye opposed abstentions let the record show it passed unanimously thank you very much for all your hard work thank you all right uh that brings us to item 7b

Cordell Hindler said he had shared pictures of other cities' galas with the task force. A councilmember called the plan appropriately sized, festive but not extravagant, with something every month, and echoed Goudey's call for 100% renewable power in the 100th year. Abelson reported the Tree Committee's idea of a centennial tree planting, and envisioned 100 oaks planted on Arbor Day in the shape of a 100; since the year's schedule would be printed by 1 January, she asked staff to have the liaisons put the centennial on every committee's next agenda, and staff said ideas arriving later could still be added online. She thanked the co-chair, Donna Hauser.

Asked about the budget by Abelson, who continued with “two more quick questions,” the presenters explained the mayoral portrait signs: the Historical Society is gathering headshots of every mayor for ovals to be carried in the parade, prompting jokes about rotten tomatoes; asked why a web page header would cost about $1,000, a presenter said it probably would not reach that amount and could serve other graphics too, and that the header work meant updating the main page's photo collage for the centennial year, and a centennial version of the city logo had been designed by a local resident, Scott Hauser. Friedman moved the resolution; Quinto seconded.

Outcome CarriedunanimousCentennial Celebration Task Force recommendations accepted unanimously.

09 A business hotel on Eastshore: the proposal captions 183–216

1:09:18um which item 7b is exclusive negotiating uh rights agreement with is it mona or mana mona and conti patel for 1718 east shore boulevard and miss vince i see you preparing a presentation i am just a single slide from the beginning good evening mayor city council my name

1:10:07is melanie mintz and i'm the city's community development director um i'm here tonight and that will be the only slide so we don't need to um it just shows the property in question i'm here tonight to recommend that you enter authorize entering into an exclusive negotiating rights agreement

1:10:22in enra with mona and conti patel for this city to proceed with good faith negotiations towards a purchase negotiating a purchase and sale agreement for 1718 east shore boulevard the patel's currently owned hotel mira vista adjacent to 1718 east shore as well as an additional parcel in between

1:10:41the hotel and the city's property the patel's approached the city with an interest in purchasing the property to build a new business hotel of approximately 100 rooms the property was bought by the former redevelopment agency in 1991 for the purpose of development

1:10:58and upon dissolution of the redevelopment agency it was included in the successor agency's long-range property management plan approved by the department of finance to be sold for development at fair market value or fair reuse value consistent with the redevelopment dissolutes dissolution

1:11:13statutes proceeds of the sale of the property will be distributed between all 22 affected taxing entities including the city of el cerrito the patels have communicated with staff that due to the property's location along i-80 and adjacent to the bart station as well as adjacent to their

1:11:30existing hotel the private property is in a prime location for a new business hotel and they are in conversation with several national business hotel brands regarding entering into an operating agreement with those hotels in order to enter into that agreement with a national brand

1:11:45those brands require that they hold title to the property from what i understand those national brands are also looking at adjacent cities so time is of the essence if council authorizes entering into an enron tonight the city will commission an appraisal of the property to

1:11:59determine fair market value and the patels will begin due diligence on the property they will also prepare a conceptual site plan um commission a market and fees financial feasibility study and obtain obtain a letter of intent from one of those hotels if at the end

1:12:14of the term of the nra the patel's wish to proceed staff would bring their proposed purchase price and concept plan to council for consideration to enter into a purchase and sale agreement as stated in the staff report the proposed hotel would bring numerous benefits to the city and the development

1:12:29of the uptown area near the bart station consistent with the city's and former redevelopment agency's long-term goals for the area it would bring foot traffic increased property tax and significant transient occupancy tax which could be reinvested to continue to benefit the

1:12:44san pablo avenue commercial areas and other city council goals if the council elects to sell the property to the patel's their proposed project would be still need to go through the entitlement process of the san pablo avenue specific plan which includes of course design review

1:12:59by the design review board environmental and traffic studies to assure the project is consistent with the specific plans eir i should point out there was one error in your agenda bill which states that our tot is 12 it's actually 10 so the estimated uh annual tot revenue is closer to about 438 uh

1:13:18thousand dollars a year estimating at 75 percent um occupancy uh mona and conti patel are here tonight if you have any questions um and that concludes my presentation uh questions i've got uh councilmember abelson mine i think it's a simple question um in looking at the

1:13:39packet in our agenda packet uh it was talking about things being in color and representing things so what i see now on this slide and you've got which i guess the other one over there you can't really tell but the one in front of me i can there we go um so what is it

1:14:01so they already own the blue at the bottom on petrero right they own both um both of the blues that's right so they own um the hotel is on one parcel and then they can tell us exactly when but over the last several years they were also able to purchase the second parcel okay so they're just what

1:14:21all they're wanting to do right now is to acquire the green one that's right okay that was i was just trying to get straight on that thank you welcome council member friedman yeah um in can we have the likes please yes sir thank you in the uh agenda report it says that

1:14:41we'll receive 22 percent of the sales proceeds with the remainder distributed amongst the other taxing entities do the other taxing entities have to agree to the sale they do so for all of our former redevelopment agency onsets we have to get into a compensation agreement with them and

1:14:59generally um karen titum is here and we're working on putting together those agreements for there and for mayfair um and generally fair market value is what the distillation dissolution statutes want and as long as you're consistent with that we assume and they see that you've used it to

1:15:15um again fair market value we assume that that won't be a problem but we do have to go through those processes so the the process is if we approve the enra tonight then you move forward with the process and the appraisal and once that's back and there's an agreed upon

1:15:32price then we and all the other entities will approve the sale at that price and then sale will proceed that's true so we would first before going to the entities we would want to make sure that um our our decision-making bodies and then we would be going to the compensation to

1:15:49the taxing entities uh so the purchase and sale would be contingent upon getting those agreements as well thank you i have one go ahead um so i have a question about the top like we um talked on the email that you changed from to ten percent the top rate from twelve

1:16:08percent but that was also based on seventy five percent occupancy um so having that many more rooms do they feel that they'd be able to reach that threshold of occupancy because there'd be marketing involved with the national chain or there's um is there a market study that

1:16:31states that they feel that they can reach that kind of capacity so again the community i don't know yeah so um i can definitely answer some and if you want to hear from more from the patel's um from a couple pieces so it's a different type of hotel it's a business

1:16:44hotel and that there is studies out there showing that there's a real need for that their current hotel runs at about 78 occupancy and there will be they will be conditioned commissioning in economic and market feasibility study to assure that so that they can also look at their

1:17:01rates of return and the economics of the project and talking to um mona she has spoken many times about how they do feel that they can attract that there's a shortage of business they feel that mira vista golf course is an attraction they might be able to do golf

1:17:16packages and that there's a lot of overflow from san francisco from the the prices being obviously what they are and then of course somewhat also from berkeley and um would either if you like to add anything to that right now or please come forward and state your name

1:17:37we want you to be videotaped for a posterity hi my name is mona patel um the feasibility studies would show and since we've been in business here for over 22 years now there is [Music] not too many rooms for corporate clientele chevron is one of the biggest corporate

1:18:07in the area right now and most of their upper level employees go and stay in walnut creek area because there is not enough rooms here the merrier in richmond is pretty much needs a lot of work and they don't prefer the area we get a lot of middle to um i'd say a lot of their construction

1:18:39workers and all that we also get a lot of uc berkeley students and the parents at the time of graduation as we speak in in summer time we wish we had 50 more rooms at least and i think i think definitely we could use a corporate hotel we are thinking more in terms of

1:19:08[Music] a myriad product if we can make it in on time because right now there are a lot of hotels going on between oakland and fairfield and the timing is a quite sensitive issue because people are taking some of the best corporate hotels and once they give it they have a limitation

1:19:33of how how far it has to be between the cities like if berkeley already has one then if we are too close and if berkeley has a bigger hotel then we might not get that brand so our main thing here is we're trying to see if we can do the feasibility studies to see

1:19:53which is a best fit for el cerrito and since we're going to have the freeway visibility for the property i think we can attract a lot more freeway clientele and our marketing department would be very important uh in this matter because that's where we're going to get a lot of

1:20:15reservations from right now we are getting more than about 50 percent out reservations from [Music] europe china japan and all over united states and i think we can if we have a corporate hotel they send corporate clients they are set corporate clients for those

Community Development Director Melanie Mintz recommended an exclusive negotiating rights agreement with Mona and Conti Patel toward selling them 1718 Eastshore Boulevard. The Patels own the Hotel Mira Vista next door and the parcel between, and want to build a new business hotel of about 100 rooms; the former redevelopment agency bought the city's lot in 1991, and under the dissolution rules it must be sold at fair market or reuse value, with proceeds shared among 22 taxing entities, including the city. National brands require that the owner hold title, and they were also looking at neighboring cities, so time is of the essence. The city would commission an appraisal; the Patels would prepare a concept plan, a market and financial feasibility study and a letter of intent from a brand. Any project would still go through design review and environmental and traffic study under the San Pablo Avenue Specific Plan. Correcting the agenda bill, she said the hotel tax is 10%, not 12%, for an estimated $438,000 a year at 75% occupancy.

Abelson confirmed the Patels want only the city's parcel. Friedman learned that the city's 22% share of proceeds requires compensation agreements with the other taxing entities, as for Mayfair, before a sale. Asked whether 75% occupancy is realistic, Mintz said the current hotel runs at about 78%; Mona Patel said that in over 22 years in business they have seen too few rooms for corporate clients, with Chevron's upper-level employees staying in Walnut Creek; in summer they wish they had at least 50 more rooms; brands limit how close their hotels can be, with many going up between Oakland and Fairfield; and more than 50% of their reservations come from Europe, China, Japan and around the country.

10 Golf, BART, a coffee shop, and the agreement approved captions 217–245

1:20:38um franchises so the chances are we can really use i mean el cerrito can really use a lot more rooms than what we have right now that was very informative so thank you welcome any more questions yeah go ahead please um so i assume that as part of the plan there will be

1:21:03plenty of rooms for corporate events community events weddings bar mitzvahs whatever right and and we are we're hoping to incorporate the golf course with this hotel so when they have tournaments if we have a big nice big franchise hotel i'm sure we can make uh have good

1:21:24packaging with um the golf club and it was kind of a blow when the uc berkeley global campus uh project got terminated that would have been a tremendous uh yeah um berkeley actually needs more rooms right now and there's not enough land they approved about i think about 400 rooms but there's uh

1:21:50oakland did a study they need 8 000 rooms and only 2 000 are going up we get a lot of overflow from san francisco because a lot of people don't prefer to stay in oakland as is because of the crime and all that and it's easy to take the part in and i guess the city of richmond has

1:22:11because of you know the crime um el cerito is preferred um place for people to come and stay so thank you ms patel one more question from uh miss abelson uh actually two of it is possible yes uh the first one has to do it with bart in general does being near bart make you more attractive yes

1:22:35okay and uh the other thing was how large would you see these how many rooms do you see this um we are uh we are hoping at least a hundred uh-huh and that would that be an addition to the uh rooms you already have or is that the rooms we have um is only 48.

1:22:57so you have 148 then i would have 148 yes okay thank you and i think the city would have a lot of t.o.t taxes coming in so we can do a lot more with that thank you ms patel this lot is quite an odd shape and one of one of the parcels one portion of the parcel is you know

1:23:21extends all the way over to san pablo avenue is that have you had any preliminary discussions with your architect to know whether you would use that that portion that's uh that faces that touches san pablo avenue so um we haven't we have consulted an architect and depending on how many car

1:23:40parking we can put underneath we're hoping to do some [Music] car parking underneath the building and if we run short then we would have to use that for parking and or we are planning a coffee shop that would be attached so we can serve the people in the morning

1:24:03besides the breakfast they can go and drink and eat there so and that that establishment would have fronted john san pablo avenue to attract you know the general public is what is what i'm hearing yeah we're hoping that architect can uh do something so we can use that

1:24:24law and it will give easier access to the bart riders and a lot of europeans actually prefer to take bart even from the airport san francisco or oakland they take bart they don't drive so it would be just perfect for the european tourists because they really do a lot of research before they travel

1:24:51it seems like great so yes thank you the rest of my questions are for staff in section 1.5 identification of developers representatives there's a blank i'm assuming that would be the patel's let me get there um page page page i don't know i think i have a section 1.5 good um

1:25:16identification of develop yes that's right uh the developers representatives yes that's right i mean they will designate but i would assume it is the patel's okay and then um in their in the very first in recital a there's a reference to exhibit a and i understand that exhibit a we had a

1:25:39supplemental page delivered to us today tonight with regards to exhibit a but it starts with parcel three so i'm wondering what happened to parcels one and two i might pass head on to karen tiedemann who um prepared the legal description our council uh tweeterman

1:26:03thank you so this is how it's designated in the official records and i assume that person one and two or somewhere else on that block and was part of that subdivision at the time it was done got it but you didn't own those parcels got it so going to the question i asked ms

1:26:20patel a few minutes ago with regards to what looks like parcel three which is uh sorry yes parcel three which is lot nine in block 18 and according to the assessor's map that is the rectangular portion that faces saint pablo avenue is there any is there any advantages to the patels or

1:26:41to us to create a lot line adjustment that allows the sail to be two parcels such that if at some point there is a larger development in the block uh north of uh the parcel that we currently own you know i'm looking at it it's a single-family home and looks like three

1:27:01single-family homes from the satellite photo if at some point those were purchased and a a larger parcel larger project was put in on san pablo avenue it might be advantageous for the rectangular lot to be a separate parcel is there is there any ad is there any

1:27:20um is it possible for us to subdivide this parcel so that we are return parcel 3 back to a separate parcel status you and sell it to the patels as as a separate parcel is there any advan advantageous uh to us and to them to making that subdivision in during this enron period

1:27:42during 120 days well i think that's sort of a question that needs to be explored as part of their site planning there will have to be some merger of parcels and potentially resubdivision but that will depend on their building plans as because you can't cross proper uh

1:28:01personal lines with the building right so yeah it that's that's sort of once they get through a more refined site concept great plan yeah it's just but it would be possible to create a parcel that would be um potentially a part of a development along saint pablo avenue in the future

1:28:25is that is that that's sort of the underlying question i think that yeah i don't think there's any prohibition against doing that if it worked for the development great great um any other questions of staff at this time staffing council no do we have public speakers on this item i have no

1:28:43requests oh we do it we have a show of hands i signed up for 7b i don't have a i had a 7. we had a 7a did you did you would you like to speak on this item you can fill out a card go ahead please mr handler so um i did have some discussions with the um with the um the president for a parkview

1:29:03neighborhood association um and she had somebody some concerns also she she has been inside some hotels um and she said there's not enough hotels in um around el cerrito so i'm like this is an opportunity for to bring in some revenue for the city so i hopefully that you will let you um

1:29:22adopt this resolution and um so that so the hotels can be bringing the richmond i mean el cerrito you're starting to think like an el cerrito resident mr mr friedman is there any other speakers before we come back to council no mr friedman i'm always gratified when an indigenous el

1:29:42cerrito merchant with a long track record like the patel's wants to expand their business in our community because they are known responsible and you know respected members of our business community so i'm very happy that you find it profitable to enter into this agreement and move forward on a

1:30:01hotel which i think we all agree is very much needed in this town and you know as opposed to other possible uses the taxes we'll receive from this are quite a bit greater generally so i think it's an all-around great deal and i would like to move the resolution if

1:30:20it's okay i think mr quinto wanted to do it so i'm going to let him read it i'm going to let him read it thank you resolution of the city council of the city of el cerrito authorizing execution of an exclusive negotiation negotiating rights agreement with mona and conti patel for their disposition of

1:30:381718 east shore boulevard second motion by quinto seconded by friedman all those in favor please say aye aye opposed abstentions all right let the record show uh passed unanimously thank you very much uh thank you very much to the patels and to staff for your work on this

A councilmember asked about event space; Patel hoped to offer golf packages with the Mira Vista course, and said Oakland needs 8,000 rooms with only 2,000 going up and El Cerrito draws overflow from San Francisco. Abelson learned that being near BART helps, and that at least 100 rooms would be added to the 48 the Patels have, for 148. A councilmember asked about the lot's strip reaching San Pablo Avenue; Patel said it might hold parking if there is too little room underneath, or a coffee shop facing the avenue. The councilmember asked staff whether the San Pablo Avenue strip could be kept a separate parcel for a future larger development; staff said parcels would be merged or resubdivided as the site plan requires, and she saw no prohibition.

Cordell Hindler said the Parkview neighborhood association president told him there are not enough hotels around El Cerrito. Friedman welcomed a long-established local business expanding, called a hotel very much needed and its taxes greater than other possible uses, and let Quinto read the resolution; Quinto moved and Friedman seconded.

Outcome CarriedunanimousExclusive negotiating rights agreement with Mona and Conti Patel for 1718 Eastshore Boulevard approved unanimously.

11 Liaison reports: Measure X's failure captions 246–253

1:31:02looking forward to it coming to cerrito all right um that brings us to item eight council assignments and liaison reports i have nothing it's that time of year i think i already mentioned my tree committee report and i i mentioned my mayor's conference report um there i guess there's one thing i

1:31:26could mention um about ccta which i guess i think we haven't met i don't know if we've mentioned this before or not maybe not uh is that major x failed um so as a result uh projects that would have been funded by that measure won't go forward and so funding for

1:31:47a variety of things ranging from paratransit to bus service to bart cars to um return to source which is money that could be been used for repaving roads and i'm there's the list goes on so all of those things will not be happening as a result of that and uh and that that's just

1:32:18things that would have happened in el cerrito remind me please how much time we have left on that current measure the current measure go i forget the exact year but it's um more than a decade and maybe more than two decades but these are um things that understand

1:32:43what i said is still true which is to say that um so there's a problem the most serious part of that problem i would say is funding the bart cars because there's a serious uh shortage of that funding for that and there aren't a lot of funding sources that could be

1:33:01could have been used for it so i don't know what will happen at this point i'm going to a meeting tomorrow night and i'm not sure if it will be discussed there but it theoretically could be but um it it's it's difficult to know at this point um but there were a number of measures that

1:33:21went down to defeat this time so it just apparently wasn't the right time for a number of measures so anyway mm-hmm seeing no other reports move on to item 9 which is adjournment of the regular city council meeting the next regularly scheduled city council meeting is

1:33:45tuesday december 6th at 7 pm in the city council chambers we're adjourned you

A councilmember reported from the CCTA that Measure X failed, so the projects it would have funded, from paratransit and bus service to BART cars and return-to-source money that could have repaved roads, will not happen; the most serious problem is funding for BART cars, with few other sources. The current measure has, the speaker said, more than a decade left, perhaps more than two. The Council adjourned to 6 December.
